Comments:
An unannounced non-mandated inspection was initiated on 1/30/2024 and concluded on 2/6/2024. The inspection was based on a self-report regarding an injury that required outside medical attention. The inspector reviewed compliance in administration, staff qualifications & training, staffing & supervision, special care provisions & emergencies, and special services. Staff and witnesses were interviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-40-L
Description: Based on staff interviews the center did not ensure they informed all staff who work with children of children?s allergies.

Evidence: Staff #1, responsible for overseeing snack time, said they were not aware of child #5?s dairy allergy.

Plan of Correction: Staff retraining as to allergies in each classroom. List of allergies (general) posted in each class. Personal allergies listed (confidentially).

Standard #: 8VAC20-780-340-A
Description: Based on document review and staff interview the center did not ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.

Evidence: The director confirmed that child #5 (age 4) has a diagnosed dairy allergy and on January 25th the child was given yogurt during snack time which resulted in an allergic reaction that required the administration of the child's emergency Benadryl and Auvi-Q Epipen. 911 was called, and the child was taken to the hospital.

Plan of Correction: Allergy list posted in each classroom for all staff. Retraining sessions for staff on allergy prevention and response. Known allergens eliminated from classrooms.

Standard #: 8VAC20-780-560-P
Description: Based on staff interviews and document review the center did not ensure a child with a diagnosed food allergy shall not be served any food identified in the written care plan required.

Evidence: Staff confirmed that child #5 who has a diagnosed dairy allergy, identified on their written allergy care plan, was served yogurt.

Plan of Correction: All known allergens (food) removed from classroom. Procedure changed to eliminate dairy, nuts from classroom.
