Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing department on 08/02/2019 regarding ratio, physical plant, emergency preparedness, nutrition, and programming. The inspection was initiated on 08/08/2019 and completed on 08/08/2019. On 08/08/2019, the inspector was on site from 11:00am to 12:30pm. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. The preponderance of the evidence gathered during the investigation does not support the allegation; therefore, the complaint is determined to be not valid. Though not a part of the original complaint, there was a violation found during the inspection regarding physical plant. See the violation notice for more details. Description: Based on observation, the center did not ensure that areas and equipment of the center, inside and outside, were maintained in a clean, safe and operable condition. Evidence: The following safety hazards were observed on the playground by the inspector on 08/08/2019: 1. Two exposed nails were protruding from the tall wooden fence. 2. There was a yellow shelf located on the playground with peeling paint and vinyl. The areas observed were within the reach of children.

Plan of Correction: 1. Standard Correction Starling ensures that areas and equipment inside and outside the center are maintained in a clean, safe, and operable condition. Starling employs 38 staff who clean the playgrounds and classrooms on a daily M-F basis. Starling also employs 3 janitors who clean the inside of the center 5 days a week and some Saturdays. Starling employs 2 [staff] full time 40 hours per week and 1 [staff] 20 hours per week to paint, repair, maintain, and check for safety issues. 2. Preventative Strategies The director meets weekly with the above 5 1/2 [staff] to review problem areas and correct any new issues. The outside reading area is made of solid wood, not vinyl. The [staff] took the book shelf to Goodwill even though we could not find the vinyl you sited. When you pulled the plank away from the lower support bar, you exposed two nails which had been attached to the lower support bar. The [staff] screwed the plank to the support bar so that no one can pull it out. 3. Responsibilities As the Director, I am responsible for the center and all its departments, including janitorial and preventive maintenance. The janitors supervisor is [staff A]. [Staff A] meets with me and my staff and [staff A's] staff each Thursday to review strategies to maintain a safe and sanitary building. [Staff B] and I meet with 2 1/2 maintenance [staff] 4-6 times a week. [Staff C] and [staff D] are responsible for implementation of our plan.
