63.2(17) License & Registration Procedures

Comments:
The licensing inspector conducted an unannounced renewal inspection on Friday, August 30, 2019 to determine the center?s compliance with licensing standards. The inspector was on site from 11:10am to approximately 3:45pm. The center?s director was present and assisted the inspector throughout the inspection. The census for today?s inspection consisted of 116 children in the care of 18 staff. There were additional staff members available on site. Upon the inspector?s arrival, the children were engaged in a variety of activities. The children in the 3?s and 4?s class were observed playing in different centers and later as they cleaned up to participate in circle time. The children interacted with their peers and the staff. The children were observed singing songs and later as a story was read to them. The children in the 2?s class were observed as they were eating lunch in their designated classroom. The staff were observed engaging with the children and serving seconds as needed. Hand-washing procedures were observed in this class. The children in the Young Preschool class were observed after they finished lunch. The children and staff washed their hands and later went outside to their respective playground. The mobile infants were observed during transition to nap time. The children in the Infant B room were observed sleeping, and being held and fed by staff. The children in the Infant A room were observed interacting with staff, eating lunch, and doing tummy time. The Toddlers were observed after they returned to the center from a nature walk with the staff. They were observed washing hands and later preparing for nap time. The younger school age children were observed with their group after a water-play activity. The inspector was informed that the older school age group was at an amusement park for the day. The playgrounds were inspected. The classrooms are decorated with the children?s artwork and are equipped with age and stage appropriate materials. The center had the following posted: license, daily schedule, emergency numbers, evacuation maps, and various parent information. The menu was posted and today?s lunch consisted of turkey and cheese on wheat bun, sliced carrots, and diced peaches. The center?s first aid kit and non-emergency supplies were inspected and found complete. During the inspection, ten children?s records, ten staff records, five agents? background checks, and four medications were reviewed.

Standard #: 63.2(17)-1721.1-B-2
Description: Based on record review and interview on 08/30/2019, the center did not ensure the results of a fingerprint based background check were completed for five agents, hired prior to January 22, 2018, by September 30, 2018.

Evidence: 1) The fingerprint based background check results for Agent #1 were dated 08/05/2019. 2) The fingerprint based background check results for Agent #2 were dated 08/15/2019. 3) The fingerprint based background check results for Agent #3 were dated 07/30/2019. 4) The fingerprint based background check results for Agent #4 were dated 07/30/2019. 5) The fingerprint based background check results for Agent #5 were dated 07/23/2019. 6) During interview, a member of management confirmed that Agent #1, Agent #2, Agent #3, Agent #4, and Agent #5 were hired prior to 01/22/2018, therefore the fingerprint based background check results were due by 09/30/2018.

Plan of Correction: The fingerprint results for all agents have been obtained. In the future, new agents will submit fingerprints timely.

Standard #: 63.2(17)-1721.1-B-3
Description: Based on a review of documentation and interview on 08/30/2019, the center did not request a search of out-of-state founded complaints of child abuse for one agent who has lived outside of Virginia within the last five years.

Evidence: 1) The Sworn Disclosure Statement reviewed for Agent #1 indicated the agent had lived outside of Virginia within the last five years. There was no documentation of a requested founded complaint of child abuse from the state the agent indicated he had lived in within the last five years. Agent #1 was an existing employee at the center when the Code of Virginia changed, effective 07/01/2017, requiring out-of-state central registry searches. The out of state request should have been submitted by the facility no later than 09/01/2017. 2) During interview, a member of management confirmed an out-of-state central registry search has not been requested for Agent #1.

Plan of Correction: The out-of-state central registry search will be sent for Agent #1 and forwarded to the licensing inspector upon receipt. In the future, sworn disclosures will be reviewed to determine when an out-of-state check is required.
