22VAC40-185 STAFFING AND SUPERVISION. 63.2(17) License & Registration Procedures

Comments:

An unannounced monitoring inspection was conducted today from 3:05pm - 4:30pm. There were 28 children in care ages four years through ten years old with two teachers, one of whom was the program director. Children's records and staff emergency contact information were reviewed on site. Staff records are housed at a central location and were reviewed on the same day as the center inspection. A walking of the cafeteria and rest rooms was completed. Required postings, annual inspections, emergency evacuation drills first aid kit, medication and transportation were reviewed. The center director reported that there was not any medication being administered and there was not any transportation offered. Children were observed in teacher and self-directed activities including restroom routines, hand washing, snack, homework and learning center play. Violations regarding ratio and background checks were identified and appear on the violation notice. The violations were reviewed with the program director on site at the conclusion of the inspection and the administrator present at the conclusion of the record review.

Description:	Based on observation, documentation and interview the center failed to ensure that when children are regularly in ongoing mixed age groups, the staff-to-child ratio applicable to the youngest child in the group will apply to the entire group. Evidence: 1 - Upon entering the child care room there were 28 children present, ages four to ten years old, with two staff. The ages and number of children present require three staff. a. There were 28 children present with two staff from 3:15pm through 3:40pm. 2 - Staff 3 and 2 confirmed that staff 4 routinely arrives at 3:40pm. 3. Staff 3 confirmed that the program is routinely out of ratio during the first 20 to 30 minutes until staff 2 arrives.
Plan of Correction:	Center management will consult with program administrators to revise staffing patterns so that the program is operating within ratio from the beginning of the after school program until all scheduled staff arrive.

Description:	Based on record review and interview the center failed to ensure that each staff submit to fingerprinting prior employment. Evidence: 1 - The record for staff 2 does not contain documentation of fingerprint results. a. Staff 2 has a documented date of hire as September 4, 2019. b. Staff 2 was present and providing direct care to children during the inspection today. 2 - Staff 1 confirmed that there are not fingerprint results on file for staff 2
Plan of Correction:	All staff records will be reviewed prior to working on the floor. If a staff is rehired, their staff records must be reviewed prior to the rehire date. In addition, the facility director or designee(s) will conduct staff records audits at quarterly that will include auditing for the required documentation. The program administrator and director(s) will be responsible for these actions.
