Comments:
An unannounced monitoring inspection was conducted today from 12:30pm through 2:00pm. There were 12 children in care with two staff. Children's records and staff emergency contact information was reviewed. Children were observed in teacher and self-directed activities including lunch, transitions, restroom routines, hand washing and nap. Required postings, annual inspections, first aid kit, insurance and emergency items were reviewed. Violations in the areas of physical plant, programs and special care provisions and emergencies were identified and appear on the violation notice. These violations were reviewed with the site director at the conclusion of the inspection.

Standard #: 22VAC40-185-270-A
Description: Based on observation the center failed to ensure that areas and equipment of the center inside and outside are maintained in safe and operable condition.
Evidence:
1 - There is "Panda Climber" on the playground that has a crack in the plastic that is approximately four inches in length. The cracked plastic has created a pinch point.

Standard #: 22VAC40-185-280-B
Description: Based on observation and interview the center failed to ensure that hazardous substances are kept in a locked place using a safe locking method that prevents access by children.
Evidence:
1 - There were spray cans of disinfectant in each of the two bathrooms located in the hallway across from the classroom. The cans were sitting inside cabinets that were unlocked.
a. Children were observed using the bathrooms during the inspection.
b. The labels on the cans state keep out of reach of children and caution.
2 - Staff 1 confirmed that there were two cans of disinfectant in unlocked locations in both bathrooms across the hall from the classroom.

Standard #: 22VAC40-185-330-B
Description: Based on observation the center failed to provide resilient surfacing as required.
Evidence:
1 - There was grass and weeds growing up through the resilient surface in the fall/use zone of the "Panda Climber, which negates the resiliency of the surface."
2 - There was approximately three feet and four inches between the "Panda Climber" and the chain link fence were six feet is required.

Standard #: 22VAC40-185-400-B
Description: 1 - From approximately 1:10 through 1:16 pm children were expected to sit at the tables and take turns going to the restroom. However, several children engaged in rolling on the floor, getting pillows out and laying on them and physically "playing" with each other while rolling on the floor.
2. Staff 2 attempted to gain control over the children by using a raised voice to issue commands and directives which included:
a. "No, table, table" repeated four times.
b. When the children did not respond to these directives, staff 2 stated, " No toys, table, table." "We're not doing that."
c. Staff 2 repeated " No, no, we're not doing that" 9 times.
d. Finally, staff 2 ended with "stop stop come here."

Description: Based on observation and interview the center failed to demonstrate having one working, battery-operated radio in each building used by children.
Evidence:
1 - The battery operated radio is not working today.
2 - Staff 1 stated that the batteries needed to be replaced.
