Comments:
12/18/19 - The Violation Notice was amended as a result of a first step review.

An unannounced renewal inspection was completed onsite on December 2, 2019, from approximately 10:00 a.m. to 1:30 p.m. and off site to review additional records on December 5, 2019. Forty-four children were in care and approximately thirteen staff were on premises during the inspection. Staff and children were observed in classrooms and on the playground engaged in activities to include activities for infants, outside play, lunch time and nap time. Interviews and interactions were conducted and medications were reviewed. Eight children?s records, six staff records and two agents of the applicant records were reviewed. The administrative assistant was available for the inspection and was present at the exit interview at which time inspection findings were reviewed and an Acknowledgement of Inspection form was signed and left with the licensee.

Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and return it within five business days of receipt. Specify how the deficient practice will be or has been corrected. The plan of correction should contain: 1) step(s) to correct the noncompliance with the standard(s), 2) measure(s) to prevent the noncompliance from occurring again and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 22VAC40-185-70-A
Description: Based on a review of staff records, the licensee failed to maintain all the elements of staff?s records for one of six staff.
Evidence: 1. Staff #1's record, hired on July 15, 2019, lacked two references required for the job position.

Plan of Correction: Per facility: Staff #1 started as a volunteer and VCU student (Volunteers are not required to have reference checks and VCU students are not required by VCU to have reference checks rechecked since they already complete them upon entering the university). One set of references is on file in VCU SOE and the other set of references is on file in the Office of Undergraduate Admission. The staff was promoted to a Center Assistant position due to excellence in service. I was not able to retrieve the second reference for Staff #[1] from the Office of Undergraduate Admissions because the student waived her right to review it and it is against University policy to release it. However, the reference is on file here at the University. Because of our desire to comply with licensing standards, we went ahead and secured a second set of references for Staff [#1].

Standard #: 22VAC40-185-270-A
Description: Based on observation of outdoor space, the licensee failed to ensure that areas and equipment of the center are maintained in a clean, safe and operable condition.
Evidence: 1. A house with an attached slide and play area underneath was observed on the playground and accessible to children. Each of the four corners of the play area underneath the house contained metal rods with triangular tops fastened to wood by pieces of exposed metal. The rods were protruding approximately two inches above ground, causing a hazard along with the exposed metal edges.

Plan of Correction: Per facility: "Work order was put in (see attached). Work is commencing."

Standard #: 22VAC40-185-340-F
Description: Based on observation and an interview, the licensee failed to ensure that children under 10 years of age were within actual sight and sound supervision of staff.
Evidence:
1. An incident report, dated September 10, 2019, was reviewed. The report indicated that Child #1, under 10 years of age, "was left outside for a few minutes without supervision." The report further indicated that staff did not do a head count when coming inside from the playground and that another child's mother saw Child #1 and brought her inside. 2. In an interview with Administrator #1, she acknowledged this incident occurred as written, leaving Child #1 unsupervised.

Plan of Correction: Per facility: "Teacher notified assistant director right away when incident happened. Situation was discussed with teacher, proper policies and procedures were reviewed, and corrective/disciplinary action was taken. Teacher immediately notified parent of the incident."

Standard #: 22VAC40-185-510-N
Description: Based on a review of records, the licensee failed to notify a parent after a medication authorization expired that the medication needed to be picked up within 14 days, and then failed to dispose of medications that were not picked up.
Evidence: 1. A medication authorization, for a skin cream, was observed for Child #6 with an expiration date of October 17, 2019, and the cream was still on site at the time of inspection.

Plan of Correction: Per facility: "Medication was not picked up by parent. Meds were thrown away."
