Comments:
An unannounced complaint inspection was conducted in response to a report that was received by the department on October 3, 2019 regarding allegations of forbidden action. The inspection was initiated on Thursday, October 17, 2019 from 7:35 AM to 8:40 AM and completed on Friday, November 15, 2019 from 9:30 AM to 11:30 AM. This was a joint investigation with two local agencies. Documentation was reviewed, interviews were conducted and video footage was reviewed.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. In addition to the original complaint, there were also violations found during the inspection not related to the complaint. See the violation notice for more details.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Description: Based on review of video footage, the center did not ensure that when staff were supervising children, they shall always ensure their care and protection.

1. On 09/26/2019, a ratio of one staff for every four children ages birth to 16 months was not maintained.
2. At approximately 7:43 AM - 7:45 AM a member of management relieved staff #1 in classroom #1. When staff #1 returned to classroom #1, management member exited and left staff #1 with six children, ages 16 months and younger.
3. On September 26, 2019, at approximately 7:58 AM, an additional child arrived leaving staff #1 with six children, ages 16 months and younger.
4. On September 26, 2019, at approximately 8:34 AM another staff member arrived in classroom #1.

Description: Based on review of video footage, the facility did not maintain a ratio of one staff member for every four children ages birth to 16 months.

Evidence:
1. At approximately 7:35 AM on 09/26/2019, staff #1 was supervising five children, ages 16 months and younger in classroom #1.
2. On September 26, 2019, at approximately 7:58 AM, an additional child arrived leaving staff #1 with six children, ages 16 months and younger.
3. On September 26, 2019, at approximately 8:34 AM another staff member arrived in classroom #1.

Description: Based on review of video footage, the center did not ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:
1. On 09/26/2019 at approximately 7:52 AM, a child crawled from foam mat to carpeted area. Staff #1 placed hands around infant's ankles and pulled the child back to the foam mat.
2. On 09/26/2019 at approximately 2:14 PM, staff #1 picked an infant up by one arm to change activities.
3. On 10/02/2019 at approximately 8:03 AM staff #1 picked up an infant by one arm to relocate the child.

Description: Based on review of video footage, the center failed to ensure that staff does not roughly handle children.

Evidence:
1. On October 11, 2019, video footage of classroom #1 was reviewed from 09/26/2019 and 10/02/2019.
2. On September 26, 2019, at approximately 7:52 AM, video footage showed staff #1 putting hands around ankles and pulling an infant on floor.
3.On September 26, 2019, at approximately 2:07 PM, video footage showed staff #1 pull an infant by the arm.
4. On September 26, 2019 at approximately 2:14 PM, video footage showed staff #1 picking up an infant by one arm to change activities.
5, On October 2, 2019 at approximately 8:03 AM, video footage showed staff #1 picking up an infant by one arm to move the child.
