Comments:
An unannounced complaint inspection was conducted on Friday, January 10, 2020 from 1:58 PM to 2:40 PM in response to a complaint received on November 26, 2019 regarding allegations of forbidden actions. Interviews with staff were completed and documentation was reviewed. The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

The director was available for the inspection and was present at the exit interview at which time inspection findings were reviewed and an Acknowledgement of Inspection form was signed and left with the licensee.

Please complete the ?plan of correction? and ?date to be corrected? for each violation listed on the violation notice and return it to me within 5 business days from receipt. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Description: Based on a review of the center's policies and procedures, the center did not ensure activities and services were maintained with the center's own policies and procedures required by the standards.

Evidence:
1. The director stated that staff #1 was placed on administrative leave on November 26, 2019 for not following center policies regarding positive guidance and behavior guidance.
2. Child #1 (date of birth 12/18/17) needed his shoelaces tied. Child #1 was sitting on the floor. Staff #1 pulled child by his feet over to tie shoelaces.

Complaint related: Yes
Description: Based on an interview with the director, the center did not ensure that staff does not roughly handle children.

Evidence:
1. The director reported that on November 25, 2019 staff #1 pulled child #1 close to her by using the child's feet.
2. The director reported that staff #1 was going to tie the child's shoes.
3. The director stated that staff #1 was placed on administrative leave on November 26, 2019 for not following center policies regarding positive guidance and behavior guidance.

Plan of Correction: The teacher was sitting on the floor with a group of children. As one child crawled away the teacher noticed his shoe was untied and she pulled him back towards her by his ankle in order to tie his shoe. This interaction was witnessed by a parent watching the cameras in our front lobby. The teacher was placed on administrative leave while we reviewed video tape to determine what the parent saw. After reviewing the tape it was determined there was no malice or rough handling of the child and the teacher was brought back from administrative leave. She was counseled on better ways to handle the situation to avoid any misunderstanding from onlookers.
