63.2 Child Abuse & Neglect

Comments:
A complaint investigation was conducted with the local agency regarding forbidden action: rough handling on February 14, 2020. Inspection time: 10:30 a.m. to 2:15 p.m. Staff interviews were conducted. Documentation was reviewed. Additional documentation and interviews were conducted off site.

Based upon the information gathered during the investigation, the complaint regarding rough handling was determined to be valid. Please provide plan of correction for the documented noncompliance by close of business April 13, 2020.

Standard #: 22VAC40-185-410-1
Complaint related: Yes
Description: Based on a review of documentation and staff interviews, it was determined that a staff engaged in a forbidden action when they roughly handled a child in care. Evidence: On January 23, 2020, Staff A grabbed Child A, age two, by the wrist to attempt to get Child A to use the bathroom. Child A pulled away from Staff A causing an elbow dislocation. Outside medical treatment was obtained and the child was diagnosed with subluxation of the left radial head (nursemaid's elbow). Staff A received a written "Personnel Action Form" on January 27, 2020 that stated: "According to Staff A, Child A was running away from her as she was trying to get her to use the bahtroom, as she was holding her wrist the child snatched away causing her to hurt her arm (dislocated/nurse's maid elbow)" "These actions are a clear violation of unaccepted actions to our children parameters laid forth in state licensing code 22 VAC-185-410-A.... restricting movement, forcing a child to assume an uncomfortable position".

Plan of Correction: The Employee was retrained, coached and a veteran teacher model for her on how to appropriately assist a child and properly lift a child when needed. In addition, she received a Personnel Action Plan for her actions.

Complaint related: No
Description: Based on a review of documentation and staff interviews, it was determined that staff of the center failed to report suspected child abuse or neglect as required by ?63.2-1509 of the Code of Virginia. Evidence: On January 23, 2020 Child A, age 2, reported not feeling well and that her arm hurt. The child was taken for medical treatment and received a diagnosis of subluxation of left radial head (nursemaid?s elbow).
Staff A received a written ?Personnel Action Form? on January 27, 2020 that stated: ?We are mandated reporters by law. If for any reason we suspect child abuse, neglect, or child maltreatment we will report such incidents to Child Protective Services.? Staff of the center did not make a report to Child Protective Services.

Plan of Correction: In addition, to the Personnel Action Plans, every faculty member retook the state training on Recognizing and Reporting Child Abuse and Neglect
