Comments:
An investigation was initiated on 2/18/20 in response to a complaint received by the Eastern Regional Office on that same date regarding an injury to a child. An on-site inspection was conducted on 2/24/20 and interviews with staff were completed. Documentation and records related to the complaint were also reviewed. Based on information gathered during the investigation the complaint is determined to be valid. One violation in the area of administration is identified on the violation notice and was discussed with the center owner on 4/27/20.

Description: Based on interviews, video footage and a review of the center's policies, the center failed to ensure that the operational responsibilities of the licensee shall ensure that the center's services are maintained in compliance with the center's own policies and procedures that are required by these standards.

Evidence:
The center failed to follow their written policy regarding injuries to children, which states "If the accident involves a head injury or blood, or is of a serious nature, the child must be checked by office staff" and that the office will "notify a parent by phone concerning any head or facial injury to the child."
1. On 2/12/20, child 1, age 2 years, sustained a facial injury when he bumped into another child and then tripped and fell, hitting the side of his face on the floor.
a. Staff 1 stated she completed an injury report after child 1 fell and hit his face but did not contact the office to inform administration of the injury and stated she informed child 1's parent of the injury at pick-up that afternoon.
b. Staff 1 stated she was aware that the center's policy for a head or facial injury to a child is to immediately inform administration in the office of the injury and for the parent to be notified by phone.
c. Staff 2 (center owner) and staff 3 confirmed that staff 1 did not inform administrative staff in the front office of the facial injury to child 1 after the accident occurred, as required per center policy.

Plan of Correction: The center responded with the following: On the day we received the complaint we spoke to staff 1. Although she did complete the injury report, which was signed by the parent on the day of the injury, staff 1 did not inform the office so that a call could be made to the parent ahead of pick-up time. Staff 1 has received training concerning written policies in regard to reporting injuries. In addition, we have spoken to all staff about the importance of following through with our documentation policies and when to inform our administrative staff.
