Technical Assistance:
We discussed the requirements for following written policies and procedures. A risk assessment for a violation was provided.

Comments:
A complaint concerning the prevention of the spread of illness, ensuring the care and protection of children and compliance with the center's written policies and procedures was received on March 18, 2020 and investigated remotely by phone on March 18, 20 and 23, 2020 during interviews and by a review of information submitted from the center by email. The investigation was completed remotely due to the COVID-19 pandemic and the Virginia State of Emergency. After a careful review of pertinent information, it was determined that the complaint was partially valid and the center did not follow all required policies and procedures. A violation notice and plan for correction were completed.

Description: Based on phone interviews with staff, and a review of written policies and procedures, the center failed to comply with its' own policies and procedures. Evidence: After 4:00 PM on Monday, March 16, 2020, staff member 1 observed that infant 1 had a possible fever and use of a thermometer revealed a temperature. A parent was contacted to arrange for pick-up of the child. Parents were reminded of the center's written illness policy that states children "May return to center when symptom free for 24 hours without the assistance of medication or is released by a physician". On the morning of Tuesday, March 17, 2020, infant 1 was accepted for care in the infant room by staff at 9:36 AM without confirmation that a physician's note was received by FAX or brought to the center by a parent. A physician's note was never received on March 17, 2020.
Late that morning, center staff began contacting the parents to arrange for pick-up of infant 1 who did not leave until 2:13 PM.

Plan of Correction: The director spoke with each of the staff in the infant room involved in the care of the infant and reviewed the center policies and procedures for illness and the exclusion of children. The administrative staff will work with the infant staff regarding procedures for ensuring that a parent has provided a physician's note if a child is to attend less than twenty-four hours of having a fever or other symptoms of illness which would require exclusion from the center.
