Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on 7/27/20 and concluded on 7/29/20. The director was contacted by telephone to initiate the inspection. There were 45 children present and 13 staff present. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 3 children?s records and 10 staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-60-B
Description: Based on a review of ten staff records, it was determined that the facility did not ensure that the facility did not ensure that an employee must not be employed until a sworn statement or affirmation has been completed.

Evidence:
1. The record for staff #1 (date of hire 6/15/20) contained a sworn statement or affirmation that was dated 7/2/20, which was completed after staff #1 began employment.
2. The record for staff #3 (date of hire 6/15/20) contained a sworn statement or affirmation that was dated 6/25/20, which was completed after staff #3 began employment.
3. The record for staff #5 (date of hire 6/18/20) contained a sworn statement or affirmation that was dated 6/24/20, which was completed after staff #5 began employment.
4. The record for staff #10 (date of hire 7/6/20) contained a sworn statement or affirmation that was dated 7/8/20, which was completed after staff #10 began employment.
5. Staff #11 reviewed the staff records for staff #1, staff #3, staff #5, and staff 10, and confirmed that the sworn statement had been signed after these staff began employment.

Plan of Correction: The facility responded: In the future, newly hired staff will be complete the sworn statement or affirmation prior to beginning employment.

Standard #: 22VAC40-191-60-C-2
Description: Based on a review of 10 staff records, it was determined that the facility did not deny continued employment of a staff who did not have a search of the central registry finding within 30 days of employment.

Evidence:
1. The record for staff #9 (date of hire 6/15/20) did not contain documentation of a completed search of the central registry finding.
2. Staff #11 (Program Director) reviewed the record for the staff #9, and confirmed that the search of the central registry finding has not been received.

Plan of Correction: The facility responded: We contacted the Office of Background Investigations to check the status of staff #9's search of the central registry, and they said they had not received it. So, staff #9 will complete a new search of the central registry and the results will be forwarded to our Licensing Inspector once they are received. In the future, all newly hired staff will complete a search of the central registry and it will be mailed off with in 7 days of beginning employment. The Program director will ensure the completed results are received within 30 days or contact the Office of Background Investigations if the results have not been received. Staff 7, staff #8, staff #9, and staff #10 have scheduled appointments to complete their national criminal history record check (finger printing).

Standard #: 63.2(17)-1720.1-B-2
Description: Based on a review of ten staff records, it was determined that the facility did not ensure that an employee is allowed to begin employment without a completed national criminal history record check (finger printing).

Evidence:
1. The record for staff #7 (date of hire 6/22/20) did not contain documentation of a completed national criminal history record check (finger printing).
2. The record for staff #8 (date of hire 6/24/20) did not contain documentation of a completed national criminal history record check (finger printing).
3. The record for staff #9 (date of hire 6/15/20) did not contain documentation of a completed national criminal history record check (finger printing).
4.The record for staff #10 (date of hire 7/6/20) did not contain documentation of a completed national criminal history record check (finger printing).
5. The record for staff #1 (date of hire 6/15/20) contained documentation of a completed national criminal history record check (finger printing) that was dated 7/15/20, which was indicates it was completed after staff #1 began employment.
6. The record for staff #2 (date of hire 6/15/20) contained documentation of a completed national criminal history record check (finger printing) that was dated 7/14/20, which was indicates it was completed after staff #2 began employment.
7. The record for staff #3 (date of hire 6/15/20) contained documentation of a completed national criminal history record check (finger printing) that was dated 7/14/20, which was indicates it was completed after staff #3 began employment.
8.The record for staff #5 (date of hire 6/18/20) contained documentation of a completed national criminal history record check (finger printing) that was dated 7/14/20, which was indicates it was completed after staff #5 began employment.
9. Staff #11 (Program Director) reviewed the records and confirmed that new employees were allowed to began employment without a completed national criminal history record check (finger printing).

Plan of Correction: The facility responded: In the future, all newly hired staff will complete a national criminal history record check (finger printing) before beginning employment. Staff 7, staff #8, staff #9, and staff #10 have scheduled appointments to complete their national criminal history record check (finger printing), and once the results are received they will be forwarded to our Licensing Inspector.
