Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A focused inspection was conducted 7/15/2020, 7/30/2020, and 8/11/2020. A self reported incident was received by the department regarding supervision. The inspector emailed the director a list of documentation required to complete the investigation. Written information was obtained from the center on 7/30/2020 and the police report was obtained on 8/17/2020. Additional information was obtained 9/14/2020.
The evidence gathered during the investigation supports the allegations of non-compliance with standards or law.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on interviews with staff and review of supervision policies, the facility failed to follow the center's own policies and procedures that are required by these standards. Evidence: the center's playground supervision policy states "Staff must cover the playground so that all kids can be seen at all times" and "Kids must not be allowed to leave the playground unsupervised." On 6/30/2020, at approximately 5:36 p.m., staff reportedly could not locate Child 1 (age 5 years) during a game of "hide and seek" on the playground. Between 5:40 and 5:42 p.m., law enforcement returned the child to the facility, where it was determined he walked off of the property alone.

Plan of Correction: Fencing was placed around the back side of property so that children could not leave the area. Staff meeting was held to review all safety expectations.

Standard #: 22VAC40-185-340-A
Description: Based on interviews and a review of documentation, the facility failed to ensure that when staff are supervising children, they always ensure their care, protection, and guidance. Evidence:
1. On 6/30/2020 at 5:36 p.m., leadership was informed that Child 1 (age 5 years) was unable to be located on the playground.
2. Between 5:40 and 5:42 p.m., law enforcement returned the child to the facility. Law enforcement advised that a passerby filed a report at 5:30 p.m. when the child was found walking alone on the road of Hickory Park Drive and stated he was lost. The child was found approximately one block away from the center, and reportedly walked through a path in the woods and then a number of parking lots before reaching Hickory Park Drive.
3. Child 1 was described by law enforcement as being very scared and timid.
4. Hickory Park Drive is a four-lane road, and the speed limit where the child was found is 35 MPH.

Plan of Correction: Reviewed head count procedures with all staff. Head counts were checked every 15 minutes during ride out with rosters. Leadership staff is required to be outside and with children during ride out.

Standard #: 22VAC40-185-340-F
Description: Based on interviews and a review of documentation, the facility failed to have all children under the age of 10 years old within actual sight and sound supervision. Evidence: At approximately 5:36 p.m. on 6/30/2020, leadership was informed that "a (5 year old) child had wandered away from supervision of counselors and other staff". Staff searched for the child until law enforcement arrived between 5:40 p.m. and 5:42 p.m. with the missing child, who had been located approximately one block away from the facility. A passerby found the child walking alone on the road of Hickory Park Drive and contacted police at 5:30 p.m. It is estimated that the child was out of sight and sound supervision of staff for 10 to 15 minutes.

Plan of Correction: Staff meeting held to review all safety expectations.
