63.2(17) License & Registration Procedures

Technical Assistance:
Provided consultation on:
1) Standard 560C: Scheduling snacks or meals so there is a period of no more than three hours between each meal or snack.
2) Standard 560G: When food is brought from home, the center shall have extra food or shall have provisions to obtain food to serve to children so they can have an appropriate snack or meal if they forget to bring food from home, or bring an inadequate meal or snack.

Effective July 1, 2020 SB 668 requires licensed child day centers to obtain a copy of the results of a criminal history name search and sex offender registry check from any state in which the individual has resided in the preceding five years.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was conducted on 10/6/2020 with an exit interview on 10/30/2020. The child care manager was contacted by telephone and a virtual inspection was conducted. There were 21 children present, ages five years - 12 years of age, with two staff supervising. The Inspector reviewed two children's records, two staff records, the emergency drill log, medication, meals and snacks, hand washing, enhanced cleaning and sanitizing of toys and surfaces, and daily indoor and outdoor activities. The information gathered during the inspection determined non-compliance with standard that are documented on the violation notice issued to the facility.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on review of two staff records, and staff interview, it was determined that no Out of State Child Abuse and Neglect Search request was received by the end of the 30th day of employment, and no follow up was documented 45 days after the initial search request. Evidence: the record for staff #2, (date of hire: 8/11/20) who indicated that they have lived out of the state of Virginia in the past five years, had no documentation of the results of an out of state child abuse and neglect search.

Plan of Correction: Going forward will ensure all staff obtain proper background checks by required due dates.

Description: Based on review of two staff records, and staff interview, it was determined that not all staff had results of a criminal history record information check and sex offender registry check from any state in which the applicant has resided in the preceding five years, prior to employment. Evidence: the record for staff #2, (date of hire: 8/11/20) who indicated that they have lived out of the state of Virginia in the past five years, had no documentation of a criminal history record information check or sex offender registry check from the other state(s) they resided in.

Plan of Correction: Going forward will ensure all staff obtain proper background checks by required due dates.
