Technical Assistance:
Emergency contact information for staff was discussed.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A renewal inspection was initiated on 11/30/2020 and concluded on 12/02/2020. The director was contacted by email to initiate the inspection. There were 60 children present and 6 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 4 children?s records and 7 staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-60-B
Description: Based upon review of seven staff records and staff interview, the facility has not ensured that an employee of a licensed child welfare agency must be denied continued employment if the licensed child welfare agency does not have a central registry finding within 30 days of employment.
Evidence:
1. The record provided for staff 6 indicated a date of employ of 9/8/2020. The record did not include the results of a child protective services central registry search.
2. Follow-up contact with the Office of Background Investigations was not made until an email contact on 12/2/2020.
3. Staff 1 verified that the record for staff 6 did not include results of a child protective services central registry search.
4. Staff 6 was on duty with the children during the inspection.

Plan of Correction: The facility responded with the following:
We will continue to follow-up upon the CPS central registry search for staff 6 and request again, if necessary. In the future, CPS central registry searches will be sent within 7 days of employ. If results are not received within the first 30 days, the Office of Background Investigations will be contacted to inquire as to the results of the request.

Description: Based upon review of seven employee records and staff interview, the facility has not ensured that they have obtained a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years prior to employ.
Evidence:
1. The record provided for staff 7 indicated that staff 7, who began employ in September 2020, lived in two states other than Virginia within the past five years. The record did not include results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from these two states.
2. Staff 1 verified that results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from the two states were not obtained.

Plan of Correction: The facility responded with the following:
Results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from the two states for staff 7 will be immediately obtained.
In the future, results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years will be obtained prior to employ.
