22VAC40-185 STAFFING AND SUPERVISION.

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring investigation of self-reported incident was initiated on August 28, 2020 and concluded on October 7, 2020. The program director was contacted by to initiate the virtual, remote investigation. The reports states that a child sustained an injury requiring doctor?s attention while in care. Center staff were interviewed. Attendance, one child's record and two staff records were reviewed. The information gathered supports the allegation. Therefore, the report is valid.
Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Standard #: 22VAC40-185-340-A Description: Based on interview and review of documentation staff failed to demonstrate compliance in providing care and protection to children.
Evidence:
1 - Child 1's fingers became caught in the step petal of diaper trash can and required stitches for the injury.
2 - Staff 1 and 2 stated that their backs turned to the child's location when the incident occurred.Plan of Correction: The trash can has been removed from the classroom.
Standard #: 22VAC40-185-340-F Description: Based on interview and observation the center failed to demonstrate compliance ensuring children under 10 years of age always be within actual sight and sound supervision of staff.
Evidence:
Neither staff had sight supervision of child 1 when he crawled from the play area of the room to the opposite side of the room where he his fingers became caught in the step petal of the diaper trash can.
1 - Staff 1 stated that she was preparing an infant bottle with her back to child 1 when she heard him crying.
2 - Staff 2 stated that she was sitting on the far side of the child care room, with her back to child 1 when she heard him crying.Plan of Correction: Staff have been retrained in maintaining sight and sound supervision at all times.
