Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A monitoring inspection was initiated on 12/17/20 and concluded on 2/17/21. A self-reported incident was received on 12/15/21 by the department regarding allegations in the areas of behavior guidance and supervision. The provider was contacted by telephone to conduct the investigation. The inspector emailed the director/provider a list of documentation required to complete the investigation. The evidence gathered during the investigation supported the self-report of non-compliance with standards or law and violations were issued. All violations related to the self-report can be found on the violation notice.

Violations:
Standard #: 22VAC40-185-80-B
Description: Based on interviews and a review of documentation, it was determined that the licensee did not ensure that the center shall inform the commissioner's representative as soon as practicable but not to exceed one working day of the circumstances surrounding any suspected incident of child abuse shall be reported in accordance with ? 63.2-1509 of the Code of Virginia.

Evidence:
1. The Licensing Inspector received a self-report from the facility on 12/15/20 about an incident where staff #1 had a conflict with child #1 on 12/10/20.
2. During interviews, staff were asked if they had contacted the local child protective services (CPS) agency about the incident between staff #1 and child #1. All staff stated that they had not contacted CPS. CPS was not contacted until staff #3 (Program Administrator) was instructed to do so by the Licensing Inspector.

Plan of Correction: The facility responded: The new Director as of 1/18/21 will ensure all guidelines for reporting a suspected incident of child abuse is reported immediately.

Standard #: 22VAC40-185-400-A
Description: Based on a review of video footage, interviews, and a review of documentation, it was determined that the facility did not ensure that staff shall interact with the child and one another to provide needed help, comfort, support.

Evidence:
1. In video footage provided by the facility, staff #1 is seen approaching child #1 to get a cell phone that child #1 has refused to put away even after being asked by staff #2 to do so. As staff #1 approaches her, child #1 sits down on the floor and staff #1 puts her arms around her from behind in an attempt to get the cell phone. Staff #1 stands up after an unsuccessful attempt to get the phone, but then goes back down to the floor in an another attempt to get the cell phone. Then staff #1 is seen picking child #1 up off the floor in another attempt to get the phone while child #1 tries to separate from her. Staff #1 eventually lets child #1 go after unsuccessfully trying to get the phone. Staff #1 is then seen walking away from child #1, throwing her hands up in the air.
2. Staff #3 (Program Administrator) stated that staff #1 was not using appropriate behavior guidance when interacting with child #1.

Plan of Correction: The facility responded: Staff will be trained regularly on behavior guidance. All staff will be required to complete The Role of Staff in Behavior Guidance and New Staff Orientation, which covers child protection training.
