Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on February 23, 2021 and concluded on March 1, 2021. The in-charge person was contacted by telephone to initiate the inspection. There were zero children present and zero staff. The licensing inspector emailed the in-charge person a list of items required to complete the inspection. The Inspector reviewed two children records and two staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliance with applicable code sections and violations were documented on the violation notice issued to the facility.

The provider must send documentation to the LI that the background checks have been requested no later than 10 days following this notification dated, March 1, 2021.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-40-D-1-A
Description: Based on review of the business entity page submitted 2/12/2021 and staff interview, the facility failed to have required background checks for each Board officer and agent within 30 days after the change. Evidence:
1. Staff member #3 stated that Agent #1 (hired 1/1/2020) did not have documentation of a sworn disclosure statement or search of the central registry (CPS check).
2. Staff member #3 stated that Board officer #2 (took office 1/1/2020) did not have documentation of a sworn disclosure statement or search of the central registry (CPS check).
3. Staff member #3 stated that Board officer #3 (took office 1/1/2017) did not have documentation of a sworn disclosure statement or search of the central registry (CPS check).
4. Staff member #3 stated that Board officer #4 (took office 1/1/2021) did not have documentation of a sworn disclosure statement or search of the central registry (CPS check).

Description: Based on the review of the two staff records, the center did not request the results of a criminal history record information, sex offender registry check and a search of founded complaints of child abuse or neglect within the required timeframe from any state in which the applicant had resided in the preceding five years for one staff member.
Evidence:
1. The record for Staff #1 (hire date 8/7/2018) indicated the staff had resided in another state outside of Virginia within the last five years. The record did not contain a sex offender registry check from the state the staff member had resided. The out-of-state sex offender registry is required to be obtained prior to hiring.
2. Staff #1 completed the out-of-state sex offender registry search on 02/23/2021 and sent the results to the licensing inspector.
