Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. A monitoring inspection was initiated on 4/6/21 and concluded on 4/7/21. The director was contacted by telephone to initiate the inspection. There were 44 children present and 5 staff present. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 4 children?s records and 4 staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility. The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-160-A
Description: Based on a review of four staff records, it was determined that the facility did not ensure that each staff member shall submit documentation of a negative tuberculosis screening. Documentation of the screening shall be submitted no later than 21 days after employment and shall have been completed within 12 months prior to or 21 days after employing.

Evidence:
1. The record for staff #4 (date of hire 8/18/20) did not contain documentation of a negative tuberculosis screening.
2. Staff #5 (Program Administrator) reviewed the record for staff #4, and confirmed that the documentation of a negative tuberculosis screening had not been received.

Plan of Correction: The facility responded: Staff #4 will complete a TB screening. Going forward all new employees will have a completed TB screening within 21 days of employment.

Standard #: 22VAC40-191-60-C-2
Description: Based on a review of four staff records, it was determined that the facility did not deny continued employment of a staff who did not have a search of the central registry finding within 30 days of employment.

Evidence:
1. The record for staff #4 (date of hire 8/18/20) did not contain documentation of a completed search of the central registry finding.
2. Staff #5 (Program Administrator) reviewed the record for the staff #4, and confirmed that the search of the central registry finding was not available for viewing during the inspection.

Plan of Correction: The facility responded: The search of the central registry for staff #4 was completed previously, but we are unable to find it.. Staff #4 will complete a new search of the central registry. We will forward the completed copy to our Licensing Inspector as soon as we receive the results.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on a review of four staff records, it was determined that the facility did not ensure that an employee is allowed to begin employment without a completed national criminal history record check (finger printing).

Evidence:
1. The record for staff #4 (date of hire 8/18/20) , working during the inspection, did not contain documentation of a completed national criminal record background check (finger printing).
2. Staff #5 (Program Administrator) reviewed the record for the staff #4 and confirmed that the results of the national criminal record background check (finger printing) was not available for viewing during the inspection..

Plan of Correction: The facility responded: The national criminal record background check (finger printing) for staff #4 was completed previously, but we are unable to find it.. Staff #4 will complete a new national criminal record background check (finger printing). We will forward the completed copy to our Licensing Inspector as soon as we receive the results.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on a review of four staff records, it was determined that the provider did not ensure that the center obtain a copy of the results of the search of the central registry and the sex offender registry check from any state in which the applicant has resided in the preceding five years.

Evidence:
1. The record for staff #3 (date of hire 7/6/20) did not contain documentation of a completed the search of the central registry and the sex offender registry check from the state of New York. The sworn statement or affirmation located in the record for staff #7 indicated that staff #7 lived in the state of New York within the last 5 years.
2. Staff #5 (Program Administrator) reviewed the records for the staff #3, and confirmed that the required out-of-state background checks were not received for staff #3.

Plan of Correction: The provider responded: We will request the required out-of-state background checks for staff #3 and forward the results to the Licensing Inspector when received. All new employees that have lived outside the state of Virginia will not start until the criminal history record information check and sex offender registry check from the state they previously resided in has been received, and complete a search of the central registry from that state also..
