Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.

A monitoring inspection was initiated on 08/05/2021 and concluded on 08/09/2021. The director was contacted by telephone and a virtual inspection was conducted. There were 64 children present with 13 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of four child records and four staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-185-70-A
Description: Based on a review of four staff records, the center did not obtain the required information for three out of four staff members.

Evidence: 1) The record for Staff #1, hired on 02/26/2021, did not contain documentation that two or more references as to character and reputation as well as competency were checked before employment. 2) The references in the record for Staff #3, hired on 07/08/2021, did not contain the required components for references that were taken over the phone. The references were missing the signature of the person making the call. 3) The references in the record for Staff #4, hired on 05/25/2021, did not contain the required components for references that were taken over the phone. The references were missing the signature of the person making the call. Staff records should contain documentation that two or more references as to character and reputation as well as competency were checked before employment or volunteering. If a reference check is taken over the phone, documentation shall include: dates of contact; names of persons contacted; the firms contacted; results; and signature of person making call.

Plan of Correction: Per the Center: "Moving forward, we will be using VDSS reference papers to more clearly state references and who completed them."

Standard #: 63.2(17)-1720.1-B-2
Description: Based on a review of four staff records and interview, the center did not ensure four staff members obtained a fingerprint based background
check determination letter prior to employment.

Evidence: 1) The fingerprint determination letter in the record for Staff #1, hired on 02/26/21, was dated 03/01/21. 2) The fingerprint determination letter in the record for Staff #2, hired on 07/12/21, was dated 07/13/21. 3) The fingerprint determination letter in the record for Staff #3, hired on 07/08/21, was dated 07/12/21. 4) The fingerprint determination letter in the record for Staff #4, hired on 05/25/21, was dated 05/27/21. 5) During interview, a member of management confirmed the center did not have the results of a fingerprint based background check for Staff #1, Staff #2, Staff #3, and Staff #4 prior to hire.

Plan of Correction: Per the Center: "Staff hire date will be after fingerprints come back. No training will occur until after."

Standard #: 63.2(17)-1720.1-B-4
Description: Based on a review of three staff records and interview, the center did not obtain a copy of the results of a sex offender registry check and a search of the child abuse and neglect registry within the required time frame from any state in which one individual had resided in the preceding five years.

Evidence: 1) The record of Staff #4, hired on 05/25/21, indicated the staff had resided outside of Virginia in the last five years. The record did
not contain the results of an out-of-state sex offender registry check from the state the staff member had resided prior to hire. The record did not contain an out-of-state search of the child abuse and neglect registry check from the state the staff member had resided. The out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of being hired. 2) During interview, a member of management reported the required out-of-state background checks for Staff #4 had not been requested.

Plan of Correction: Per the Center: "Completed via phone. Sex offender record. Sent out other check needed."
