This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.
A renewal inspection was initiated on 08/24/2021 and concluded on 08/25/2021. The director and assistant director were contacted by telephone and a virtual inspection was conducted. There were 108 children present with 21 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of five child records and five staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 63.2(17)-1721.1-B-4 Description: Based on a review of documentation and interview, the center did not ensure that one applicant obtained a copy of a sex offender registry check and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years within the required time frame.
Evidence: 1) During interview, a member of management reported Applicant #1 became a resident of a state outside of Virginia in April 2020.
2) The record for Applicant #1 did not contain a copy of a sex offender registry check or a search of the child abuse and neglect registry or equivalent registry from the state the applicant has resided. An out-of-state criminal history record information check was not required because the state participates in the National Fingerprint File (NFF) program through the FBI.
3) The results of the out-of-state background check searches were required to be obtained by December 31, 2020 for existing applicants prior to July 1, 2020. Applicant #1 was an applicant prior to July 1, 2020.Plan of Correction: Per the Center: "As soon as the violation was received the assistant director immediately reached out to applicant #1 to let him know what was needed to be done ASAP.
We have a specific spread sheet that alerts management when staff are in need of renewing their background checks. Applicant #1 had resided in VA since opening the center 15 years ago, he is on the spreadsheet, and has all the necessary VA background checks in compliance because that is where the center is in operation. We added another line for his new out of state background checks. He is in contact with the necessary department to resolve this violation.
The director along with the assistant directors will be responsible for monitoring and preventing of this violation."
