63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.
A monitor inspection was initiated on September 27, 2021 and concluded on September 29, 2021. The administrator was contacted by telephone to initiate the inspection. There were 31 children present with five staff. The inspector emailed the administrator a list of items required to complete the inspection. The Inspector reviewed three children?s records and four staff records, along with any requested program records submitted by the facility to determine if required documentation was complete.
Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review and interview the center failed to ensure that fingerprint background checks are obtained prior to employment.

Evidence:
1 - The record for staff 2 contains a documented date of hire as August 16, 2021. However the date documented on the fingerprint background check is August 23, 2021. Therefore the fingerprint was obtained after the date of employment.
2 - Staff 1 confirmed that the fingerprint background check was not obtained prior to employment.

Plan of Correction: We allowed staff #2 to take part in the teacher work week prior to school starting and before we received her background check results. We received her background results before children were in attendance. We now fully understand this is against policy and will not do so again with any future hires.
Date to be corrected: 9/30/21 when we learned it was against policy

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review an interview the center failed to obtain required out of state Central registry background checks prior to employment
Evidence:
1 - The record for staff 2 contains a out of state central registry background check dated September 15, 2021. However the documented date of employment for staff 2 is August 16, 2021. Therefore the required out of state central registry background check was obtained after employment
2 - The record for staff3 contains an out-of-state background check dated May 20, 2021. However the documented date of hire for staff three is April 12, 2021. Therefore the required out of state central registry background check was obtained after the documented date of hire.
3 - Staff 1 confirmed that the out-of-state central registry background checks were obtained after the documented date of hire.

Plan of Correction: We were not ware of the July 2020 policy change until now. We now fully understand the policy change and will strictly follow it with all new hires. We have never allowed new hires to work with children unless we had the results of their fingerprint background checks. We always applied for these other background checks immediately, but did not realize the new policy required us to wait for the results of them as well. The results of these additional background checks often take 4 to 6 weeks to be returned to us.
Date to be corrected: 9/30/21 when we learned there was a change in policy
