Comments:
An unannounced complaint inspection was conducted in response to a complaint that was received by the department on 09/28/2021 regarding allegations in the area of nutrition and food services. The inspection was initiated on 10/04/2021 and completed on 10/07/2021. Interview and review of documentation was conducted remotely.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 22VAC40-185-560-F
Complaint related: Yes
Description: Based on review of documentation and interview, the center did not ensure when meals or snacks are provided, that the most recent age-appropriate nutritional requirements of a recognized authority such as the Child and Adult Care Food Program of the United States Department of Agriculture (USDA) are followed.

Evidence:
1. Four menus were reviewed which documented that juice was regularly served at 2 snacks per day. Cookies and cereal bars were listed on the menu as a grain component for several snacks.
2. The most recent USDA/CACFP meal patterns limits juice to once per day. Grain based desserts are not to count as a grain component.
3. Administration acknowledged that the menu did not meet the USDA/CACFP nutritional requirements for the snacks.

Plan of Correction: Our center submitted all master menus (four weeks) to Virginia State Licensing for review. We currently serve all children a morning snack, hot lunch, and afternoon snack each day. All 20 lunches met current USDA food requirements. Some of our snacks did not meet the recent USDA revisions. Working in partnership with our State Licensing Specialist, we immediately revised our snack menu to meet the most recent requirements. We were happy to make these adjustments which will give us the opportunity to continue to provide this most valuable service to our clients. Many centers do not offer meals and we know our clients appreciate our willingness to navigate these federal policies. There will be no need for continued monitoring since our master menus are not altered. It should also be noted that this violation is deemed a ?zero risk? violation and does not carry a risk assessment by Virginia State Licensing.
