22.1 Early Childhood Care and Education

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review and interviews.

A monitoring inspection was initiated on 11/29/2021 and concluded on 12/06/2021. The program director was contacted by telephone and a virtual inspection was conducted. There were 23 children present, ranging in ages from 4 years to 13 years, with 6 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 3 child records and 3 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Violations:
Standard #: 22.1-289-036-D
Description: Based on record review and interview with the program director, it was determined that the center did not ensure that employees that had lived out of the state of VA within the last 5 years have in their files the results of an out-of-state Child Abuse and Neglect search request by the end of the 30th day of employment; and the results of an out-of-state Sex Offender Registry search request and an out-of-state Criminal History Name check, both prior to first day of employment.
1) In the following documentation, results were not obtained prior to the first day of employment:
For Staff #2 (start date 8/16/2021), the results of a Sex Offender Registry search from the state of MI were dated 08/29/2021, and the results of a Criminal History Name Check from the state of NJ were dated 09/13/2021.

2) In the following documentation, compliance could not be established since the documentation in the record was not dated:
a- For Staff #1 (start date 8/16/2021), a search request for Child Abuse and Neglect that had been requested to the state of DC, and the results of a Sex Offender Registry search from the state of SC.
b- For Staff #2 (start date 8/16/2021), the results of a Child Abuse and Neglect search request and the results of a Criminal History Name Check, both from the state of MI.

Plan of Correction: Staff #2 began working at the school on August 16th (per teaching contract), but staff #2 did not work in Extended Day until 10/2021

Description: Based on record review, the center did not ensure to obtain a VA fingerprint-based criminal history check determination letter prior to first day of employment for one staff person.
Evidence:
1) The record for Staff #2 (start date 8/16/2021), contains a fingerprint-based criminal history check determination letter dated 09/16/2021.

Plan of Correction: Staff #2 began working at the school on August 16th (per teaching contract), but staff #2 did not work in Extended Day until 10/2021

Description: 8VAC-770-60-C
Based on record review, the center did not ensure that employees must not be employed until the center had the person's completed sworn statement or affirmation.

Evidence:
1) The record for Staff #2 (start date 8/16/2021), contains a sworn statement or affirmation form dated 08/30/2021.

Plan of Correction: Staff #2 began working at the school on August 16th (per teaching contract), but staff #2 did not work in Extended Day until 10/2021

Standard #: 8VAC20-780-70
Description: Based on record review and interview, staff records did not contain all required information.
Evidence:
1) The record for Staff #2 did not contain documentation that two or more references as to character and reputation as well as competency were checked before employment. 2) On the dates of inspection, the director searched the record for Staff #2 and could not locate the documentation.

Plan of Correction: References for staff #2 were requested from the school and added to our own file, too. (versus just the school's file).

Standard #: 8VAC20-780-540-C
Description: Based on review of the emergency supplies, the emergency kit did not contain all required components.
Evidence:
1) On the date of inspection, the first aid kit did not contain a second triangular bandage.

Plan of Correction: We only had one bandage in the first kit looked at, but we did have 1 bandage in each kit (totaling 3 triangular bandages) at the time of inspection.

Standard #: 8VAC20-780-550-D
Description: Based on documentation review, emergency evacuation procedures were not practiced monthly.
Evidence:
1) On the date of inspection, the 2021 emergency drills log provided for review, did not document an evacuation (fire) drill documented for the month of January 2021.

Plan of Correction: Our log provided started with February 2021. I did not provide the page before, which listed drills occurring 08/2020 - 01/2021.

Description: 8VAC20-820-120-E-2
Based on review of required posted documents and interview with the program director, the center did not ensure that all required documents related to the terms of the license were posted on the premises of the program.
Evidence:
1) On the date of inspection, the findings of the most recent inspection of the facility (02/2021) were not posted. 2) The program director could not locate the inspection notice posted.

Plan of Correction: Inspection re-printed and added to correct display location.
