Comments:
An unannounced subsidy health and safety inspection (SHSI) was initiated and concluded on September 7, 2022. The licensing inspector was onsite from approximately 9:30am until 11:30am. There were five children in care and one caregiver present. See violation notice for additional information. A monitoring inspection was also conducted on this date.

The information gathered during the inspection determined non-compliances with subsidy regulations, and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 8VAC20-790-170-C
Description: Based on review of one household member?s record and interview, the vendor did not ensure that one household member undergo a background check in accordance with ? 22.1-289.040 of the Code of Virginia; (ii) shall not have been convicted of a barrier crime as defined in ? 19.2-392.02 of the Code of Virginia; and (iii) is not the subject of a founded complaint of child abuse or neglect within or outside the Commonwealth.
Evidence:
1. During the inspection, Caregiver #1 could not located the background checks for Household Member #1.
2. Caregiver #1 stated Household Member #1 has lived in the house for years and required background checks for Household Member #1 had been obtained.
3. The record for the vendor maintained by the Virginia Department of Education did not contain information regarding background checks for Household Member #1.

Standard #: 8VAC20-790-170-D
Description: Based observation and interview, the vendor did not ensure that the family day home does not exceed the capacity of children cared for as allowed by law or regulation.

Evidence:
1. Five nonresident children were present in the family day home during the September 7, 2022 inspection.
2. The vendor stated she thought five children were allowed to be present in the family day home because an application to become a licensed family day home provider has been completed.

Standard #: 8VAC20-790-180-B
Description: Based on observation and interview, the vendor did not maintain a written hard copy record of daily attendance that documented the arrival and departure of each child in care as it occurred.

Evidence
Five nonresident children were observed in present at the family day home upon the inspector?s arrival. The licensing inspector asked to review the written daily attendance. The vendor stated the daily attendance had not been completed. During the inspection, the vendor wrote the children?s names and arrival times down on the attendance roster.

Standard #: 8VAC20-790-260-A
Description: Based on observation, the vendor did not ensure all areas and equipment of the family day home, inside and outside, were maintained in a clean, safe, and operable condition.

Evidence:
1. The chain link fence located in the backyard where the children play was broken at the top, creating protruding sharp metal pieces.
2. The bottom metal piece of a shed located in the backyard where the children play was bent outwards, creating a protruding sharp corner.

Description: Based on documentation review and interview, the vendor did not ensure a shelter-in-place procedures were practiced at least twice a year.

Evidence:
1. During the inspection, the licensing inspector reviewed the emergency drills practices. The drill log did not indicate shelter-in-place drills had been practiced within the last 12 months.
2. The vendor stated she had not practiced shelter-in-place drills with the children.
