22.1 EARLYCHILDHOOD CARE AND EDUCATION

Comments:
An unannounced complaint inspection was conducted on 01/13/2022. There were 41 children, ages 5 months-5 years, and 9 staff providing direct care and supervision and various support staff present during the inspection. The information gathered during this inspection determined the complaint to be valid. Non-compliance with applicable standards or law and violations are documented on the violation notice issued to the provider. The inspectors arrived for the inspection at 9:20 a.m. and departed at 11:40 a.m.

Standard #: 8VAC20-780-40-E
Complaint related: Yes
Description: Based on observations and discussion with staff, the center failed maintain compliance with the terms of the current license issued by the department.

Evidence:
1. Twelve children and three staff members were observed using a building located at 220 W. Depot St., Bedford, VA during the 01/20/2022 inspection; this building is located across the street from the licensed child day center.
2. Staff 1 confirmed that the building located at 220 W. Depot St., Bedford, VA was being used by the licensed child day center as a classroom space for their mixed delivery pre-k class.
3. The building located at 220 W. Depot St., Bedford, VA is not included in the current license issued to the center nor does it have a separate license issued by the department.
4. On 01/19/2022, a representative from another agency confirmed that the building located at 220 W. Depot St., Bedford, VA does not have a current Certificate of Occupancy that allows the space to be used for the care of children.

Plan of Correction: All of the children have been moved to the main building. Will have to go through the steps required for licensure to be able to use that space.

Description: Based on observation and discussion, the center failed to ensure that the inside areas occupied by children shall be maintained no lower than 68 degrees Fahrenheit.

Evidence: There was an indoor room temperature thermometer located on a shelf in the middle of the classroom; the temperature of the room during the 01/13/2022 inspection measured 62.6 degrees Fahrenheit.

Plan of Correction: Based on observation and discussion, the center failed to ensure that the inside areas occupied by children shall be maintained no lower than 68 degrees Fahrenheit.

Description: Based on observations and discussion with staff, the center failed to ensure that hazardous substances such as cleaning materials, insecticides, and pesticides shall be kept in a locked place using a safe locking method that prevents access by children.

Evidence:
1. There was an aerosol can of Lysol on a shelf in the classroom space that was accessible to children.
2. There was a bucket red cleaning bucket containing an aerosol can of Lysol and a toilet cleaning on the floor in front of the restroom; the cleaning materials were accessible to children.
3. The children were identified to be of preschool age.

Complaint related: No
Description: Based on observations, the center failed to ensure that when food is brought from home is shall be clearly dated and labeled in a way that identifies the owner.

Evidence: There were three cups (pink, orange and Marvel) and a Blues Clues lunch box in the cubbies of the entry way to the building that were not dated nor labeled in a way to identify the owner.

Plan of Correction: Employees were retrained.
