Comments:
An onsite complaint inspection was initiated on October 7, 2021 and concluded on February 28, 2022. Administration and staff interviews were conducted and observations were made. A complaint incident was received by the department regarding allegations in the areas of special feeding needs and supervision.

The evidence gathered during the investigation supported the allegation of special feeding needs of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Description: Based on a review of records, the center did not ensure that immunizations received shall be signed by a physician, his designee, or an official of the local health department.
Evidence: The record of infant #1 contained documentation of immunizations that were not signed by a physician, his designee, or an official of the local health department.

Description: Based on observation, the center did not ensure areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition.
Evidence: In the infant room there is chipped and peeling paint in several areas located above the kick plate of the wall exposing drywall. This area is accessible to children in care.

Description: Based on observation on October 7, 2021, the center did not ensure when staff are supervising children, they shall always ensure their care, protection, and guidance.
Evidence: Infant #1 (DOB 8/5/21) was observed asleep in an infant swing and the infant was not strapped in. Staff said she had buckled the child in and the inspector showed the staff the child was not buckled.

Description: Based on observation and interview on October 7, 2021, the center did not ensure to provide awake infants not playing on the floor or ground a change in play space at least every 30 minutes or more often as determined by the individual infant's needs and infants, who cannot turn themselves over and are awake, shall be placed on their stomachs a total of 30 minutes each day to facilitate upper body strength and to address misshapen head concerns.
Evidence: 1. Infant #2 (DOB 7/1/20) was observed in a crib, awake, for approximately 40 minutes during the inspection. 2. Staff stated she has to "contain him anyway she can." Staff stated infant #2 will stay in the crib until he falls asleep and that can be anywhere from 1.5 hours-2 hours awake. 3. Infant #1 was moved from the crib once staff were prompted to do so by the inspector.
4. Staff stated infant #1 (DOB 8/5/21) doesn't receive tummy time when awake. Staff said she doesn't put him on his tummy because he's just a newborn.

Description: Based on interview, the center did not ensure that prepared infant formula shall be dated and labeled with child's name.
Evidence: 1. An outside witness stated that staff in the infant room were discussing whose bottles were whose because the bottles were not labeled with a child's name.
2. Administration confirmed that there was a time when staff in the infant room were discussing whose bottles were whose due to the bottles not being labeled with a child's name.
