22.1 Early Childhood Care and Education

Technical Assistance:
Staff orientation training was discussed with the Director.

Comments:
A monitoring inspection was conducted on 3/23/2022. There were 19 children present, ranging in ages from infants to Kindergarten, with 17 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 5 child records and 5 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based upon review of five staff records and staff interview, the facility has not ensured that they have obtained a copy of the results of a sex offender registry check from any state in which the individual has resided in the preceding five years.
Evidence:
1. The record provided for staff 3 indicated that staff 3 has lived in Florida and Maryland within the past five years. The facility has not received results of a sex offender registry search for either state.
2. The record provided for staff 5 indicated that staff 5 has lived in Florida within the past five years. The facility has not received results of a sex offender registry check for Florida.
3. Staff 1 verified that sex offender registry searches had not been obtained.

Plan of Correction: The facility responded with the following:
We will ensure that sex offender registry searches are conducted for any state in which an applicant has lived within the past five years prior to the hire of an applicant.

Standard #: 8VAC20-780-160-A-1
Description: Based upon review of staff records and staff interview, the facility has not ensured that documentation of a tuberculosis screening shall be submitted at the time of employment and prior to coming into contact with children.
Evidence:
1. The record provided for staff 4, hired on 3/7/2022 and on duty with the children during today's inspection, did not contain documentation of a tuberculosis screening.
2. Staff 1 verified that results of a tuberculosis screening had not yet been obtained.

Plan of Correction: The facility responded with the following:
Administrators were not aware that the timing requirement for tuberculosis screenings had changed. In the future, employees will be required to obtain a tuberculosis screening within 30 days prior to employment and before coming into contact with children.

Standard #: 8VAC20-780-160-A-2
Description: Based upon review of staff records and staff interview, the facility has not ensured that documentation of a tuberculosis screening shall be completed within the last 30 days prior to employment.
Evidence:
1. The record provided for staff 5, who was hired effective 2/28/2022, was not obtained until 3/22/2022.
2. Staff 1 verified that the tuberculosis screening for staff 5 was not obtained within 30 days prior to employment.

Plan of Correction: The facility responded with the following:
Administrators were not aware that the timing requirement for tuberculosis screenings had changed. In the future, employees will be required to obtain a tuberculosis screening within 30 days prior to employment and before coming into contact with children.

Standard #: 8VAC20-780-70
Description: Based upon review of staff records and staff interview, the facility has not ensured that staff records contain all required information.
Evidence:
1. The record provided for staff 3 did not include the hire date, the job title or documentation that two or more references as to character and reputation as well as competency were checked before employment.
2. Staff a acknowledged that the record for staff 3 did not include the above documentation.

Plan of Correction: The facility responded with the following:
All required documentation will be obtained and placed in the record for staff 3

Standard #: 8VAC20-780-240-B
Description: Based upon review of records and staff interview, the facility has not ensured that staff complete orientation training no later than seven days of the date of assuming job responsibilities.
Evidence:
1. The record provided for staff 3 did not include documentation of the required orientation training. Staff 3 was covering classrooms in order to meet required adult to child staff ratios during the inspection.
2. Staff 1 verified that staff 3 began working at the facility in January 2022 and that she sometimes assisted in classrooms. Staff 1 verified that staff 3 had not completed the required orientation training.

Plan of Correction: The facility responded with the following:
All required documentation and information will be included in all staff records.

Standard #: 8VAC20-780-240-C
Description: Based upon review of records and staff interview, the facility has not ensured that orientation training of staff includes all required topics.
Evidence:
1. Documentation of orientation training of staff did not include the following:
- written staff and parent policies as required by section 8VAC 20-780.240.D
- recognizing and legal reporting requirements of child abuse and neglect
- confidentiality
- the center's policies and procedures regarding the administration of medication
- prevention and response to emergencies due to food and other allergic reactions to include:
a. recognizing the symptoms of an allergic reaction
b. responding to allergic reactions
c. preventing exposure to food and other substances to which a child is allergic
d. preventing cross contamination
2. Staff 1 verified that documentation of staff orientation training did no include the topics listed above.

Plan of Correction: The facility responded with the following:
All required topics, policies and procedures will be covered in new staff orientation and will be documented. Training on those topics not covered in staff initial orientation will be addressed at a staff training/meeting and documented. Going forward, all required topics will be addressed and documented during new staff orientation training.
