Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and an on-site tour of the program.

A monitoring inspection was initiated February 15, 2022 and concluded on February 21, 2022. The director was contacted by telephone and an on-site inspection was conducted. There were 58 children present, ranging in ages from Infant to 5 years, with 14 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of four child records and four staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-770-60-C-2
Description: Based on a review of staff records and interviews, the center did not ensure staff members had a central registry finding within 30 days of employment.

Evidence:
1. The records for staff # 2 (start date: 1/10/22), staff #3 (start date: 1/05/22), and staff #4 (start date: 1/07/22), did not contain the results of a central registry finding.
2. During interview, a member of management confirmed the central registry findings were not received within 30 days of employment for Staff #2, Staff #3, and Staff #4. The records did not contain documentation of any further contact, and the staff members had been continuously employed.

Standard #: 8VAC20-780-160-A-1
Description: Based on a review of staff records, the center did not ensure that each staff member shall submit documentation of a negative tuberculosis screening (TB) at the time of employment and prior to coming in contact with children.

Evidence:
1. Staff #2 (start date: 1/10/22) did not have documentation of the TB screening or test.
2. Administration confirmed that the documentation was not in the file.

Description: Based on a review of staff records, the center did not ensure that documentation of two or more references as to character and reputation as well as competency were checked before employment.

Description: Based on observation, the center did not ensure areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition.

Evidence:
1. On the playground, a metal brace used to hold the bottom fence picket had a protruding screw and sharp edges and fence panels around the playground had deteriorating, splintered wood.
2. On bus #1 that transports children, three rows of seats had multiple holes exposing foam.

Description: Based on observation and staff interview, the center did not ensure the prepared infant formula shall be refrigerated, dated and labeled with the child's name.

Evidence:
There was one bottle of infant formula that was not dated or labeled with the child's name. Staff confirmed the bottle was not labeled.
