Comments:
An on-site monitoring inspection was conducted on April 11, 2022 from 9:55 A.M.-3:00 P.M. There were 30 children present, ranging in ages from 21 months to five years of age, with seven staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of five child records, seven staff records, six medications, and classroom observations were conducted.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-770-60-B
Description: 8VAC20-770-60-B
Based on review of staff records, the facility failed to ensure that the sworn disclosure statement was signed prior to employment.

Evidence:
1. Staff #2?s date of hire was 11/29/2021. The sworn disclosure statement on file was signed on 01/25/2022.
2. Staff verified the date on the sworn disclosure statement and the date of hire for Staff #2.

Plan of Correction: Roberta Webb Childcare Center failed complete a sworn statement for Staff 2 and staff 3. Again, our program has been under fire with staff shortage and because I am the lead pre-K teacher and director, I have had many decisions to make under pressure that have caused these paper violations.
Both employees have had sworn statement now because we hired another fulltime office staff to help with all the loose pieces to be in compliance.

Standard #: 8VAC20-780-160-A-1
Description: Based on review of staff records, the facility failed to obtain documentation that a tuberculosis screening was on file prior to an employee coming into contact with children.

Evidence:
1. Staff #2?s date of hire was 11/29/2021. The tuberculosis screening on file was dated 01/26/2022.
2. Staff verified the date of employment for Staff #2, and the date the tuberculosis screening was obtained.

Plan of Correction: Roberta Webb Childcare Center failed to obtain a TB test on staff #2 for the following reasons. We have been understaffed for a complete year and needed an employee in the classroom immediately. Staff #2 was hired from another local childcare center and had a TB test there. Understanding TB test are not yet a portable document, we felt safe to have this staff in the classroom and fully knew we would be in violation of code 160-A-1.
When our program became more stable with employees and extra time to complete the onboarding for staff#2 the TB screening took place and the center ids now in compliance.

Standard #: 8VAC20-780-40-E
Description: Based on review of the medication policy, the licensee failed to ensure that the center?s activities and services are maintained in compliance with the center?s own policy and procedures required by these standards.
Evidence:
1. In the Family Handbook the medication policy states, ?Medication expiration dates will be checked monthly by the Director. If at any point a medication is observed to be expired, it will be immediately returned to the family by the Director. Out-dated medicine that has not been picked up by the family will be disposed of within 14 business days.?
2. Child 1M had an emergency medication that expired on 12/2021.
3. Staff verified that the emergency medication had expired on 12/2021.

Plan of Correction: Roberta Webb Childcare Center thought we had completed all the medication paper correctly. This violation has been a learning curve for me. I now have highlighted blank forms so I know exactly where to have parents sign and I now have knowledge of where the doctor should sign and date.
Also, I am adding in each child?s enrollment portal the expiration date of any medication, so we have that information daily when we sign them in in the morning.

Description: 240-B
Based on review of staff records, the center failed to have documentation that orientation was completed no later than seven days of the date of assuming job responsibilities.

Evidence:
1. Staff #2?s date of employment was 11/29/2021. There was not documentation on file that orientation had been completed.
2. Staff #3?s date of employment was 02/22/2022. There was not documentation on file that orientation had been completed.

Plan of Correction: Roberta Webb Childcare Center failed complete an orientation for Staff 2 and staff 3. Again, our program has been under fire with staff shortage and because I am the lead pre-K teacher and director, I have had many decisions to make under pressure that have caused these paper violations.
Both employees have had orientations now because we hired another fulltime office staff to help with all the loose pieces to be in compliance.

Standard #: 8VAC20-780-280-B
Description: Based on observation, the facility failed to ensure that all hazardous materials were kept in a locked location.

Evidence:
1. In the first cabinet on the left, in the bathroom that Classroom #2 uses, there was one container of Clorox Disinfectant wipes, and a bottle of Windex spray. The manufacturer?s directions stated ?keep out of reach of children? and ?hazardous to humans and domestic animals.?
2. In the first cabinet on the left, in the bathroom that Classroom #3 uses, there was two cans of Lysol Disinfectant Spray, one container of Clorox Disinfectant Wipes, and one spray bottle of Windex Spray. The manufacturer?s directions stated, ?keep out of reach of children?, and hazardous to humans and domestic animals.?

Plan of Correction: Roberta Webb Childcare Center failed to have Clorox wipes and Windex in the cabinet in the bathroom with the child lock on it for the following reason. The bathroom was painted and given a refresh and the employee just so happen to but the children baskets with extra clothes on the side of the cabinet with the lock and the cleaning supplies on the other side with no lock.
This has since been changed and a photo showing that has been sent into the inspector.
The two canisters of Clorox wipes in the 4-year-old classroom where not under the counter because we use them on a daily basis in our art center to clean up, so or tables, walls and chairs stay in good condition.
As the Executive Director/Pre-K teacher I take full responsibility for the violation. We spray bleach on tables before and after meals and allow the bleach to air dry with children walking by and on occasion touch the tables while bleach is out, so I did not think twice to have the Clorox wipes out as a cleaning measure in my class.
The Clorox wipes are now under a locked cabinet in the classroom, and we will be using a Mr. Erase on the art tables from now on.

Description: 450-B
Based on observation, the facility failed to ensure that rest mats used by toddlers and preschool age children during rest time shall have linens consisting of a top cover and a bottom cover.

Evidence:
1. In all classrooms the children were using rest mats during rest time, and they only had a top cover.
2. Staff verified that the mats did not have a linen or blanket to use for a bottom covered.

Plan of Correction: Roberta Webb Childcare Center failed to obtain pillowcases on our nap mats for the following reason.
1. I did not know this was a requirement, I have also used cots and cot sheets in the past but due to limited space in the classrooms and limited storage we sold the cots and went to mats during COVID so we could have an opportunity to clean and wipes all surfaces to keep them clean and germ free.
2. We also wash our children?s blankets daily and my thought was it is better than weekly cleaning since we have been on hyper clean mode due to COVID.
3. I am not sure when we will be getting these sheets for tops and bottoms and how we are to store them in a safe manner, so that germs are not spread since the requirement says wash weekly. If a child has lice and we don?t know that and the sheets are stored in the cubby we will be transferring lice, if a child in shoes walks on another child?s mat from washing hands after lunch causing the mat to get dirty from that child?s foot, are we to have more than one sheet set on hand for each child. I would like more clarity on this and how to implement this safety measure.

Description: 510-G
Based on review of medications, the facility failed to ensure that all medication was labeled with the child?s name, the dosage amount, and time or times to be given.
Evidence:
1. Child 3M had an emergency medication that was not labeled with the child?s name, dosage amount and time or times to be given.
2. Child 1M had a prescription ointment that was not labeled with the child?s name, dosage amount, and time or times to be given.
3. Staff verified that the medications were not labeled with the required components.

Plan of Correction: Roberta Webb Childcare Center thought we had completed all the medication paper correctly. This violation has been a learning curve for me.
