Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A self reported incident was received by the Department regarding allegations in the area of supervision. The incident was investigated jointly with representatives of two local agencies. Staff interviews were conducted by telephone on 2/22/2022 and 2/23/2022. Video footage, forensic photos, and documentation related to the incident were reviewed 2/25/2022, 3/11/2022, 3/15/2022, and 3/23/2022, and 5/19/2022.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on interviews with staff and review of supervision policies, the facility failed to follow the center's own policies and procedures that are required by these standards. Evidence: the center's supervision policy states "All children must be in sight and sound of the teacher at all times. You may not leave your classroom for any reason unless another teacher/director assumes responsibility for your class." The twos classroom was out of sight and sound supervision for a period of no less than 2 minutes. Staff A stated she was hanging children's art work, helping a child in the restroom, and getting an ice pack for a a child.

Standard #: 8VAC20-780-340-A
Description: Based on staff interviews, forensic photos, and center video footage, the facility failed to ensure that when staff are supervising children, they always ensure their care, protection, and guidance. Evidence: At approximately 2:50 p.m. on February 11, 2022, the two year old classroom is observed on video jumping on and off mat and walking around without a staff person present. Child 2 is seen hitting, sitting on, and pinching Child 1. A forensic exam with photos details at least 70 visible scratch marks on Child 1's face, neck, and back as well as a visible lower and upper jaw bite mark on Child 1's lower back. Staff A stated she was helping a child in the restroom and went to get an ice pack for the child's injured fingers. When she returned to the classroom, Child 1 was visibly injured and bleeding.

Description: Based on staff interviews and video camera footage, the facility failed to have all children under 10 years of age within actual sight and sound supervision. Evidence: On February 11, 2022, the two year old classroom was observed on video recording without a staff person in actual sight and sound supervision. The children were seen jumping on and off mats and walking around. Child 2 was seen hitting, sitting on, and pinching Child 1. Staff A stated she was helping a child in the restroom and getting an ice pack for the child's injured finger. A forensic examination details that Child 1 sustained at least 70 visible marks including scratches and a bite mark. The video recording shows the children were out of sight and sound supervision for a period of at least two minutes but the clip does not show when staff returned to the classroom.
