Comments:
A non-mandated inspection, resulting from a self-reported incident, was conducted in-person by licensing staff on 06/09/2022 and by using an alternate remote protocol, including telephone interviews and electronic review of information on 06/28/2022. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 8VAC20-780-340-A
Description: Based on video footage and discussion with the staff, the center failed to ensure that when staff are supervising children, they shall always ensure their care, protection and guidance.

Evidence:
1. Video footage shows Staff 4 and six children sitting on a carpet. Staff 4 can be seen pushing the leg of Child 1 in an effort to move the child away from the group of children; Child 1 was determined to be 20 months old. Child 1 is seen toppling over onto their side at the same time that Staff 4 pushes Child 1?s leg. Staff 1 then proceeds to push Child 1?s legs two more times. Child 1 can be heard crying in the video. There are two other staff members, one of which is holding the phone camera, in the area observing the behavior, that did not intervene during the incident.
2. In an interview, Staff 2 stated that Child 1 was not part of Staff 4?s group but wanted to participate in the activity anyway. Staff 2 stated that they could tell Staff 4 was frustrated that Child 1 wouldn?t return to their group and that Staff 2 and Staff 3 wanted to record the situation to show their boss.
3. In an interview, Staff 3 stated that Child 1 was including themselves in another group?s activity and that Staff 4 did not want the child in the activity so they began to push the child?s legs to move them away. Staff 3 stated they decided to record the situation.
4. In an interview, Staff 4 stated that Child 1 would not return to their group so Staff 4 pushed the child?s legs to get the child to move and while Staff 4 was pushing the child?s legs the child flopped themselves over. Staff 4 stated that Staff 2 and Staff 3 would not assist in getting the child to return to the correct group and chose to video rather than assist.

Plan of Correction: Staff have been reminded of how to deal with children that do not respond to verbal commands. Staff were reminded that they can communicate with the Program Director at anytime in a stressful situation. The standards were reviewed.
