Comments:
An unannounced complaint inspection was conducted on site on 7/5/2022,7/12/2022 and 7/28/2022. The inspectors arrived at 12:00 PM and departed at 1:45 P.M. Follow up interviews were completed on 7/12/2022 and 7/28/2022. A complaint was received in the licensing office on 6/28/2022. The preponderance of evidence gathered supported lack of care, protection and guidance was supported and complaint is valid.

Description: Based on observation of records, the center failed to ensure that center shall inform the department representative as soon as practicable but not to exceed two business days, or any injury to a child that occurs while the child is used the supervision of the center and requires outside medical treatment.


Evidence:
1.Child # 2 was injured while at the center on 6/21/2022. Child #2 went to the Emergency room on 6/21/22. The center did not inform the department of child # 2 receiving outside medical treatment.

Plan of Correction: All parents have been notified that if they take their child to the ER for an injury occurring at LL they must notify us immediately so we can report it. Training was provided by licensing on how to report it.

Description: Based on interviews with staff, medical reports and injury reports, the center failed to ensure that when staff are supervising children they shall always ensure their care, protection and guidance.

Evidence:
1.On the afternoon of 6/13/2022, Staff #1 took the two year old class outside to participate in water play on the playground. The children were not wearing shoes while playing on the poured-in resilient surfacing. According to the Accuweather App, the temperature on that day was 94 degree. Verified through interviews with staff # 1 and the incident form for child # 1; child # 1 burned the bottom of their feet. The child stepped on the hot part of the rubber resilient surfacing.

2.On the afternoon of 6/21/2022, Staff #1 took the two year old class to participate in water play on the playground. Staff # 1 stated that Child # 2 was wearing socks only. Verified through interviews with staff # 1 that child # 2 had blisters on the bottom on their right foot. According to staff # 1, Child # 2 refused to walk and was screaming ?feet?. The parent was notified of the injury by staff#1 via the app used at the center. The parent spoke with staff # 2 and pictures were sent to the parent. Staff # 2 told staff # 1 to apply an ice pack to the burned feet.
The medical records from the Emergency Room describe the blisters as a partial thickness burn which is also called second degree burn. According to the Accuweather App the temperature on that day was 88 degrees.

3.On July 5 2022 the inspector used a thermometer gun to verify the temperature of the resistant surfacing. The temperature was taken at approximate 11:45 AM and measured 169 degrees. According to Accuweather App the outside temperature for that day was 93 degrees.

Plan of Correction: Surface thermometer was purchased to use to ensure proper temperatures.
Regardless of temps, all children's, parents and staff were notified that shoes were not optional, that they must be work at all times outside even if a parent says its ok.
Water hose is on playground to cool it off, in case the temps are hot. A sunshade e ordered to help keep surface temps down.
