Comments:
An unannounced monitoring inspection was initiated and concluded on 11/29/2022. The inspector was on site from approximately 9:43 am-12:40 pm. There were 74 children present, ranging in ages from two (2) to five (5) years, with 11 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies, nutrition and background checks. A total of seven (7) child records and seven (7) staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word corrected is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 22.1-289.035-B-2
Description: Based on a review of seven (7) staff records and interview, the center did not ensure to obtain a fingerprint background check for one (1) staff prior to the first date of employment as required.

Evidence:
1. The record of staff #1 (date of employment: 10/31/2022) contained a fingerprint background check dated 8/18/2021.
2. Administration acknowledged that staff #1 was a rehire and a new fingerprint background check was not obtained prior to the hire date of 10/31/2022 as required.

Plan of Correction: Due to a quick re-hire of this staff member and only being gone for less than a month, administration was under the impression that her fingerprint background check was good until 8/18/2026. Administration will make sure if any staff are re-hired, they will complete a new fingerprint background check before start date.

Standard #: 22.1-289.035-B-4
Description: Based on a review of seven (7) staff records and interview, the center did not ensure to obtain an out of state criminal history name check prior to the first day of employment for one (1) staff as required.

Evidence:
1. The record of staff #2 (date of employment: 10/17/2022) contained a sworn statement that indicated that the staff had resided outside of Virginia within the preceding five (5) years. An out of state criminal name check was not located in the record.
2. Administration acknowledged that the out of state criminal name check had not been obtained prior to the first date of employment for staff #2.

Plan of Correction: Staff member #2 completed all required background checks for VA and a Child Abuse/Neglect request from a state previously resided. Administration felt we requested all required documents from the previous state but mistakenly missed the criminal history. Going further, administration will double check to make sure all required documents from a state a staff member previously resided will be requested.
