Comments:
A monitoring inspection was conducted on December 22, 2022. There were thirty-one children present, ranging in ages from thirteen months to five years old, with six staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of five child records and five staff records were reviewed.

Information gathered during the inspection determined noncompliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22.1-289.035-B-2
Description: Based on review of three staff files, the program failed to ensure that one staff completed a fingerprint based criminal history check prior to the first day of employment.

Evidence:
1. The first day of employment for Staff #2 was 9/12/2022. There was a portability form in the file that had been emailed 9/8/2022, but there were no eligibility dates included.
2. The director was shown how to open encrypted email, and had received an email that Staff #2 did not qualify for portability.

Standard #: 8VAC20-780-240-A
Description: Based on review of three staff files, the program failed to ensure that one staff completed the orientation course within 90 calendar days of employment.

Evidence:
1. The first day of employment for Staff #1 was 8/8/2022. There was no certificate in the file.
2. The director confirmed that the training had not be completed.

Standard #: 8VAC20-780-500-B
Description: Based on observation and interviews, the center failed to ensure that for children younger than three years, a changing table or counter top designated for changing was used as the nonabsorbent surface for diapering or changing.

Evidence:
1. While touring the facility, the two year old classroom no longer had a changing table.
2. Staff #4 was asked where the changing table was located, and stated that it was not relocated to the space when rooms were switched at the end of the summer. She was then asked to demonstrate diapering procedures. After attempting to use the toilet, the child stands outside the stall to complete the diaper or pull up change. If necessary, the child is placed on the lap of Staff #4 to complete the diaper change.
3. The director confirmed that the changing table was not used in the previous room, so was not relocated.
4. After reviewing the standards regarding diapering and discussing the allowable variance process, the director requested an application.
