63.2 Child Abuse & Neglect

Comments:
A self report was received by the Fairfax Licensing office from the program administration concerning care of children. Based on staff interviews, record review and observations of the playground, violations were found. Non-compliances with applicable standards or law were documented on the Violation Notice. Violations:
Standard #: 8VAC20-780-40-E
Description: Based on staff interviews and written policy review, the center staff did not ensure that the center's activities are maintained in compliance with the center's own policies and procedures that are required by the Child Day Center (CDC) standards.
Evidence:
1. Arlington's Department of Parks and Recreation Sight and Sound Supervision Plan states that "Children must be in sight and sound supervision at all times" The plan further states in the first bullet, that "Face- to -name attendance will be taken during every transition to/ from program room to other spaces in the building and to/from outdoors."
2. On February 6, 2023 when Staff #1 and Staff #2 took the group inside from the playground, they did not conduct a name-to-face check. Staff #1 stated that they went back inside and she "helped children remove their coats and use the bathroom to wash hands" and Staff #2 went to wipe down the tables for lunch. Staff #1 stated she did not do a name- to- face or check attendance when they transitioned back into the building.
3.. When Staff #1 and Staff #2 took the group inside from the playground, Child # 1 was left unattended on the playground for approximately 60 minutes, from approximately 11:30am - 12:30pm. The staff were unaware the child was still outside until Child #1's parent arrived for pick-up.

Plan of Correction: DPR's Sight and Sound Supervision plan will be reviewed with staff. Staff will complete a name-to-face recognition and head count during every transition and periodically during the program. A new transition log form will be implemented to log these checks. Window blinds should remain open to ensure visibility of the premises. Staff will check areas of reduced visibility when outside and when lining up: these include tunnels, the playground structure near the back gate and the train structure.

Standard #: 8VAC20-780-340-A
Description: Based on staff interview, staff failed to ensure care, protection and guidance when supervising children.
Evidence:
Staff #1 and Staff #2 failed to ensure Child #1's care and protection when the child was left unattended on a playground for approximately 60 minutes. Staff were inside the center and would not have been able to offer assistance to the child as they were unaware she was not inside with the rest of the children.

Plan of Correction: DPR's Sight and Sound Supervision plan will be reviewed with staff. Staff will complete a name-to-face recognition and head count during every transition and periodically during the program. A new transition log form will be implemented to log these checks. Description: Based on staff interviews, a child under 10 years of age was not within actual sight and sound supervision of staff.
Evidence:
On February 6, 2023, Child #1 (3 years of age) was left on the fenced playground area for approximately 60 minutes when the child's class went inside at 11:30 am. The 2 staff with the class did not realize the child had remained outside until Child #1's parent arrived at 12:30 pm for pick-up. Staff #1 stated (in a written statement ) that she "looked out the window to the playground and noticed Child #1 was sitting at the top of the ladder on the large playground structure".

Plan of Correction: Staff will complete name-to-face recognition and head count before going outside, when arrive outside, before returning inside and when return inside. Staff will do periodic headcounts throughout the day and communicate these with other staff. A new transition log form will be implemented to log these checks.
