Comments:
An announced complaint investigation was initiated on 03/01/2023 at 10:30am to 2:15pm with the local agency and another licensing inspector in response to a complaint received by the licensing office regarding forbidden actions. Staff interviews were conducted while onsite. Documentation and records were reviewed. Based on the preponderance of evidence collected throughout the investigation, the complaint was determined to be not valid. The violation cited was found during the course of the investigation separate from the complaint.

Description: Based on interview with staff, the center did not always ensure that staff interacted with children in a way that respects children?s personal privacy.

Evidence: Staff interviews revealed that center policy for a daily health check involved having children ages 3 through 18 years of age remove or lift up their clothing to have their bodies checked for any health concerns including bruises, scratches or other markings prior to starting their day. Interviews revealed that many children would lift or remove their clothing except their undergarments during the health check.

Plan of Correction: Robert Day Child Care Center's goal and mission is
to protect and provide quality care to children with
special needs. Per Staff reports, intentions when checking under children's
clothing was to ensure the children had no hidden
bruises, scrapes, scratches and injuries they
were unable to independently report. Their intentions
were not to disrespect the children's personal privacy.
To comply with licensing standards and prevent future concerns,
checking under the children's clothing for
injuries ceased immediately.
Staff was counseled and retrained on the proper
process of conducting health screenings.
In the future, Staff will follow the health screening
processed on the Department of Education
Licensing Standards.
Staff will respect children's personal privacy and
only screen areas of naturally exposed and based on
each child's agreement.
