Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the department on January 26, 2023. The investigation was initiated on February 28, 2023 and completed on March 15, 2023. The complaint was regarding behavioral management, special care provisions and emergencies, and staff qualification and training. The inspector was on site on February 28, 2023, from 8:35 AM to approximately 1:00 PM conducting interviews, completing observations, and reviewing documentation such as staff orientation training and annual training. The preponderance of the evidence gathered during the investigation supports part of the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the Violation Notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Description: Based on a review of policies and procedures, interviews, and a review of documentation, the center did not ensure that the center's activities and services are maintained in compliance with the center's own policies and procedures required by the standards.

Evidence:
1. The facility's Accident and Injury policy states: "If your child has a minor accident resulting in injury, our teachers will administer the necessary first aid care such as band-aids and ice packs and will complete an Accident Report form detailing the incident. This form will be given to you at the end of the day. Please sign it and return it to the Director for our records."
2. Child #1 was observed to have scratches on face. An accident report was not available for review at the time of the investigation.
3. A member of management states that the accident report could not be located.

Plan of Correction: "Written steps to complete an Accident/Injury report has been added to the Staff Manual."

Description: Based on review and an interview, the center did not ensure to maintain a written record of children's serious and minor injuries in which entries are made the day of occurrence.

Evidence:
1.The record for child #1 did not contain a record of an injury.
2. A member of management was unable to locate an accident report for child #1.
