Comments:
An investigation was initiated form 10:00 am - 12:00 pm with Local Agency CPS and Law Enforcement to investigate a complaint regarding care, protection, and guidance. Interviews were conducted, documentation and records were reviewed. The complaint regarding care, protection and guidance is determined to be valid.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Description: Based on interviews it was determined that staff did not always ensure the care, protection, and guidance of children under their supervision. Evidence: Staff could not provide an explanation regarding a dislocated left clavicle with a fracture sustained by child A (Age 17 Months) during child care hours. It was discovered through interviews that child A arrived at the day care around 9:00 am with a happy disposition. The child appeared normal throughout the day until they woke up from nap. It was reported that child A fell asleep on their back without incident at around 12:20 pm. Child A was reported to have been sleeping on their cot with a pacifier in their mouth, blanket placed over their torso, and dressed in a long sleeved shirt, legging type pants, and a onesie under the long sleeve shirt. Staff A went on break at approximately 12:45 pm leaving the children in the class under the supervision of staff B. When staff A returned from break they noticed that child A's cot had been moved and child A was still sleeping but now positioned on their stomach with their long sleeved shirt removed. Staff B reported to staff A that child A had woke up and that they had attempted to rock the child back to sleep next to their cot and that child A later fell back to sleep. It is not determined how child A's long sleeve shirt was removed. Child A reportedly woke up around 3:00 pm crying and appeared to be in distress. Staff A diapered child A, attempted to console them and offer them a snack. When child A was still observed to be in distress, staff A assessed the child to investigate the source of their distress. Staff noticed that child A appeared to flinch when their left arm and shoulder area was touched. Staff A notified management and requested that they notify child A's parent. Child A was picked up around 4:15 and was taken for medical evaluation. It was later determined by emergency room medical personnel that child A had a dislocated left clavicle with a fracture.
