Comments:
An unannounced monitoring inspection was conducted on Wednesday, March 29, 2023 to determine the center's compliance with licensing standards. The inspector was on site from4:00pm to approximately 5:15pm. There were a total of nine children in care in the direct care of two staff members. During the inspection, the children and staff were observed participating in a variety of activities. Staff were observed having positive interactions with the children. All areas of the facility used by the children were inspected. The center is equipped with toys and supplies and items were available to the children. The required postings were reviewed and found to be in compliance. Medication is administered, but there are no medications on-site at this time. During the inspection, five children's records were reviewed and applicable staff information required to be at the center was reviewed. On Thursday, March 30, 2023, the inspector conducted an unannounced inspection at the administrative office to review two staff records.

Information gathered during the inspections determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on a review of two staff records, the center did not obtain the results of a sex offender registry check and a search of the child abuse and neglect registry or equivalent registry from any state in which one staff member had resided in the preceding five years within the required timeframe.

Evidence: 1) The record of Staff #2, employed 06/14/21, indicated the staff had resided in another state outside of Virginia within the last five years. The record did not contain a sex offender registry check or a search of the child abuse and neglect registry. The out-of-state sex offender registry check is required to be obtained prior to employment. The out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of employment. 2) During interview, management confirmed the required out-of-state checks were not obtained for Staff #2 within the required timeframe.

Plan of Correction: A new request will be completed and the missing out-of-state background checks for Staff #2 will be obtained. The results will be forwarded to licensing upon receipt.

Standard #: 8VAC20-780-40-M
Description: Based on a review of documentation and interview, the center did not ensure all children with a diagnosed food allergy were included in the center's written list of children with allergies, sensitivities, and dietary restrictions.

Evidence: 1) The record of Child #3, enrolled 08/16/22, and the record of Child #5, enrolled 08/17/22, indicated the children had diagnosed food allergies. 2) The inspector reviewed the center's written list of all children's allergies, sensitivities, and dietary restrictions during the inspection on 03/29/23. The list did not include Child #3 or Child #5. 3) During interview, staff reported they were aware of the children's allergies, but did not realize they were not listed on the written allergy list on site.

Plan of Correction: Corrected on site.

Standard #: 8VAC20-780-60-A
Description: Based on a review of five children's records and interview, the center did not ensure one child's record contained the required information.

Evidence: 1) The record of Child #3, enrolled 8/16/22, indicated the child had a diagnosed food allergy, but the record did not include a written care plan to include instructions from a physician regarding the food to which the child is allergic and the steps to be taken in the event of a suspected or confirmed allergic reaction. 2) During interview, staff confirmed a written allergy care plan was not available for Child #3.

Plan of Correction: A written allergy care plan will be requested and filed for Child #3.
