Comments:
A complaint was received in the licensing office on 04/07/2023 regarding supervision and care and protection of children. On 04/11/2023, an on-site investigation was initiated. Interviews were conducted and observation of the physical plant were made. Inspection was completed on April 17, 2023. It was determined that the preponderance of evidence supported the allegation, and the complaint is deemed valid.
Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Description: Based on observation, and interviews, the center did not ensure that all areas of the center were maintained in a safe, operable condition.
Evidence
The trash bins are kept in a fenced area with a gate on both sides. One gate opens to the playground, the other to the parking lot. Per interviews, the gate on the playground side should always be locked. The side to the parking lot is unlocked for garbage pickup access.
The gate on the playground side was unlocked and missing a piece of wood, leaving an opening large enough for a child to fit through on 3/21/2023. Per interviews, the gate had been missing the piece of wood for an undetermined amount of time.

Plan of Correction: The daily playground checklist now contains a line item for checking the dumpster fence area. Morning staff are responsible for completing the checklist.
Gate/fence was repaired on March 21, 2023.

Description: Based on interviews with staff, the staff did not ensure that when staff were supervising children, they always ensure their care, protection, and guidance.
Evidence
At approximately 10:30am on March 21, 2023, the Preschool 2 classroom was outside on the large playground in the back right side of the Center.
Staff #1 was supervising children playing on the large climbing structure in the middle of the large playground.
Staff #2 was walking around the large playground supervising the other children.
Staff #3 was on the small playground on the left side in the back of the Center, preparing the infants to go back inside.
Three-year-old child #1 ran down the walkway from the large playground, past the small playground and staff #3, and around the corner of the Center.
Staff #3 yelled to staff #1 and #2. There was no response from either staff member.
Staff #3 called the Center Director from her cell phone.
Child #1 entered the area where the trash bins are kept through a broken open gate and exited through the open gate on the other side of the trash bin area, running across the parking lot and across Upper Meadow Drive, approximately 130 feet. The posted speed limit for the road is 25 mph.
Center Director immediately ran to the front of the building and brought child #1 back to the playground.
Staff #1 and #2 were not aware child #1 had left the playground.
Child #1 was unsupervised for approximately between 30-60 seconds.

Plan of Correction: Staff #1 and #2 both received written councils for safety and supervision from management.
Staff #1 and #2 received retraining on Winwood's safety and supervision., policy and practices, playground safety policies and practices, name to face policies with supervision focus from management.
Gate/fence repairs completed same day (3/21/23).

Evidence:

Staff #2 was walking around the large playground supervising the other children.
