Comments:
The licensing inspector conducted an unannounced monitoring inspection in response to a self-report that was received by the Office of Child Care Health and Safety on March 21, 2023, regarding allegations in the area of supervision. The investigation was initiated on March 28, 2023 and concluded on April 18, 2023. On March 28, 2023, the inspector was on site at the center from approximately 10:15am to 12:25pm. Interviews with the center staff were completed, and documentation was reviewed. On April 6, 2023, the inspector was on site at the center from approximately 4:15pm to 5:15pm. Interviews with the center staff were completed, observations were made at the center and documentation was reviewed. The inspector completed an additional interview on April 18, 2023.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the self-report is determined to be founded. Though not a part of the original report, there were violations found during the inspection regarding children?s records, staff records and injury reporting. Please specify how the deficient practice will be or has been corrected. Standard #: 8VAC20-780-130-A
Description: Based on record review, the center did not ensure one of two children?s records contained documentation of immunizations required by the State Board of Health before the child can attend the center.
Evidence:
The record of Child #1 had documentation of immunizations required by the State Board of Health dated 12/14/22.

Standard #: 8VAC20-780-160-A
Description: Based on record review, the center did not ensure each staff member submitted a negative tuberculosis screening at the time of employment and prior to coming into contact with children.
Evidence:
1. The record of staff #3 (employment date: 11/2/21) contained documentation of a tuberculosis screening dated 11/12/21.
2. The record of staff #2 (employment date: 12/20/21) did not contain documentation of a tuberculosis screening.
3. The record of the center representative (employment date: 1/30/23) contained documentation of a tuberculosis screening dated 2/18/23.

Standard #: 8VAC20-780-80-B-2
Description: Based on an interview, the center did not ensure to inform the department's representative as soon as practicable, but not to exceed two business days, of any injury to a child that occurs while the child is under the supervision of the center and requires outside medical attention.
Evidence:
1. On the evening of March 20, 2023, Child #1 stated to her mother that she was injured while playing on the playground.
2. The parent of child #1 reported that she took the child to be examined by a medical professional on March 21, 2023.
3. The center representative did not make a report the serious injury to the OCCHS or the Licensing Inspector within two business days of the injury.

Description: Based on record review, the center did not ensure staff completed orientation training no later than seven days from the date of assuming job responsibilities.
Evidence:
The record of staff #2 (employment date: 12/20/21) had documentation of completed orientation training as required by the Standards dated 1/22/22.

Standard #: 8VAC20-780-270-A
Description: Based on observation and interview, the center did not ensure that areas and equipment of the center, inside and outside, were maintained in a clean, safe and operable condition.
Evidence:
1. The Preschool / Pre-K playground had a yellow slide with exposed sharp plastic on the edge of the slide shoot.
2. The inspector observed one child slide down the broken slide.

Standard #: 8VAC20-780-340-A
Description: Based on interviews, the center staff did not ensure the care and protection of a child they were supervising on March 20, 2023.
Evidence:
On March 28, 2023, April 6, 2023, and April 18, 2023, the licensing inspector conducted interviews with the center director, staff #1, staff #2, staff #3 and an additional witness. Additionally, the inspector received two separate reports regarding the same incident from a local agency. The following was determined:
1. Staff #1 and staff #3 was supervising the preschool classroom, which included child #1 (age 3 years) on the afternoon of March 20, 2023, while playing on the playground.
3. On the evening of March 20, 2023, Child #1 reported to their mother the following: child #2 put a stick in between her legs and touched her ?no no spot? while playing on the playground on the afternoon of March 20, 2023. As a result, she was hurt.
2. A local agency reported the following: a. The center representative reported child #1 told her mother that child #2 touched her vagina with a stick. b. The parent of child #1 took the child to the doctor and the doctor observed redness and soreness. C. ?[Child #2] was reprimanded for having a stick the staff took the stick away.?
3. On March 22, 2023, the Office of Child Care Health and Safety received an additional report from the local agency which stated the following information was received from child #1?s healthcare provider: ?The night of 3/20/23, [Child #1] complained to her mom about being in pain from where she was hit. On 3/21/23, [Child #1] was taken to the doctor. [Child #1] showed signs of vaginal trauma but there was no bleeding, lacerations, or sign of infection. ?
