The applicant must send evidence to the licensing inspector that the background checks have been requested no later than 10 days of this notification dated 6/30/2023. The applicant must also then forward the results to the licensing inspector upon receipt.

A subsidy health and safety (SHSI) inspection was completed on 6/28/2023. A licensing inspection was also conducted on this date. Information gathered during the inspection determined violations with applicable standards or law. Violations are identified on the violation notice.

Standard #: 22.1-289.035-A Description: Based on a review of records and interview, the Provider did not ensure that All employees / Caregivers undergo a background check in accordance with subsection B prior to employment or beginning to serve as a volunteer and every five years thereafter.
Evidence:
Two Provider / Household Member records were reviewed.
The records for Provider #1 had the most recent results of a criminal record check which was dated 5/12/2018, more than 5 years ago.
The records for Household Member #2 had the most recent results of a criminal record check which was dated 5/15/2018, more than 5 years ago.
The provider confirmed that updated criminal record searches had not yet been requested.Plan of Correction: The provider will complete requests for the Criminal Record Searches for Provider #1 and Household #2 within 10 days. A copy of the requests will be sent to the inspector and the results will be forwarded upon receipt.
