Comments:
An unannounced inspection was conducted on May 5, 2023 from approximately 11:30 am to 2:15 pm in response to a self-reported incident in reference to forbidden actions that was received on May 2, 2023. Documentation was gathered and reviewed while at the center as well as electronically. Interviews were conducted.

The preponderance of evidence gathered during the investigation supports violation of standards in regard to the self-report.

Violations were issued as a result of this investigation.

Please complete the plan of correction and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today, 06/06/2023. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on documentation review and interviews, the center failed to follow their own policies related to behavior guidance. Evidence:
1) Interviews with staff #2, and staff #3, revealed that on May 2, 2023 at approximately 10:00 am, staff #1 yelled ?I can?t deal with this today? and then yelled at child #1, age 2 years ?that?s enough! You can stay in here!? as she grabbed child #1, age 2 years, by the arm and pulled the child into the bathroom. The child was left alone in the bathroom with the door shut and the lights off.
2) Review of document titled ?Guidance, Protection of and Respect for Children? OP-300 states that ?employees must adhere to all applicable state and local laws governing child guidance or discipline. Employees are required to use positive guidance techniques and to refrain from any unacceptable measures while caring for children. Unacceptable measures include separation techniques as punishment, physical discipline, verbal or emotional abuse, lack of supervision and child endangerment, etc.?

Standard #: 8VAC20-780-340-A
Description: Based on interviews, the center failed to ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance. Evidence: Interviews with staff #2, and staff #3, revealed that on May 2, 2023 at approximately 10:00 am, staff #1 yelled ?I can?t deal with this today? and then yelled at child #1, age 2 years ?that?s enough! You can stay in here!? as she grabbed child #1, age 2 years, by the arm and pulled the child into the bathroom. The child was left alone in the bathroom with the door shut and the lights off for approximately 1 minute.

Plan of Correction: Per the center "staff retrained on KCE behavior guidance and respect/protect policy on 05/11/23. Retrained on sight and sound supervision on 05/11/23."

Standard #: 8VAC20-780-400-B
Description: Based on interviews, the center failed to ensure that behavioral guidance shall be constructive in nature, age and state appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts. Evidence: Interviews with staff #2 and staff #3 revealed that on May 2, 2023 at approximately 10:00 am, staff #1 was overheard saying ?I can?t deal with this today!" and then yelled at child #1 saying ?that?s enough! You can stay in here!? as she put child #1, age 2 years, in the bathroom alone and shut the door, as a behavior guidance technique.

Plan of Correction: Per the center "staff retrained on KCE behavior guidance and respect/protect policy on 05/11/23."

Standard #: 8VAC20-780-410-1
Description: Based on interviews, the center failed to ensure that physical punishment such as roughly handling a child is not used. Evidence: Interviews with staff #2 and staff #3 revealed that on May 2, 2023, staff #1, grabbed child #1, age 2 years, by the arm and pulled the child into the bathroom. The child was heard crying and stating ?ow, I want my mommy.? Interview with the parent revealed that the child stated that her head was hit on the toilet.

Plan of Correction: Per the center "staff retrained on KCE behavior guidance and respect/protect policy on 05/11/23.

Standard #: 8VAC20-780-410-4
Description: Based on interviews, the center failed to ensure that children are not separated from the group so that the child is away from the hearing and vision of a staff member. Evidence: Interviews with staff #2 and staff #3 revealed that on May 2, 2023 at approximately 10:00 am, staff #1 put child #1, age 2 years, in the bathroom alone and shut the door, as a behavior guidance technique.

Plan of Correction: Per the center "staff retrained on KCE behavior guidance and respect/protect/protect policy on 05/11/23. Retrained on sight and sound supervision on 05/11/23."
