Technical Assistance:
Technical assistance given and licensing standards were reviewed regarding playground and locked cabinets.

Comments:
An unannounced renewal inspection was conducted on June 12, 2023. The inspector arrived at 8:30 AM and departed at approximately 10:45 AM. There were 22 children present and three staff members. A sample size of nine records were reviewed which included six children?s records and three staff records. The Inspector observed staff and children?s interactions throughout the inspection. Children were observed during group activity, free play, outdoor play, singing and music, and arts and crafts. The transportation van was observed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented. The violations are listed on the violation notice issued to the center and were reviewed with the site owner at the exit interview.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, it was determined that the center did not ensure to obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Evidence:
1. Staff #2 confirmed on their Sworn Statement (signed on 03/05/2023) that they lived in three states outside of Virginia in the past 5 years and no background checks were completed in those three states prior to employment.
2. Staff #3 confirmed on their Sworn Statement (signed on 10/28/2021) that they lived in a state outside of Virginia in the past 5 years and no background checks were completed for that state prior to employment and working with children in care.
3. Staff #1 confirmed that there were no out of state background checks completed for Staff #2 and Staff #3.

Plan of Correction: The center responded with the following: Information on how to complete the background checks were obtained by licensing. The center is now in the process of obtaining the out of state background checks in the other states. Moving forward, the center will ensure that all out of state background checks are completed prior to employment.

Standard #: 8VAC20-770-60-C-2
Description: Based on record review and interview, it was determined that the center did not ensure that staff does not have a central registry finding within 30 days of employment.
Evidence:
1. Staff #2 (date of hire 03/05/2023) does not have central registry check results completed within 30 days of employment.
2. Staff #1 confirmed that Staff #2 does not have central registry results completed.

Plan of Correction: The center responded with the following: The central registry checks have been requested and will be placed in the staff's record once received.

Standard #: 8VAC20-780-160-A
Description: Based on record review and interview, it was determined that the center did not ensure that each staff member and individual from an independent contractor shall submit documentation of a negative tuberculosis screening.
Evidence:
1. Staff #2 did not have documentation of a negative tuberculosis screening in their record.
2. Staff #1 confirmed there was no documentation of a negative tuberculosis screening in their record.

Plan of Correction: The center responded with the following: The TB screening was completed on 6/14/2023 and sent to the licensing inspector. The test is negative.

Standard #: 8VAC20-780-245-J-3
Description: Based on record review and interview, it was determined that the center did not ensure that any child for whom emergency medications (such as albuterol and epinephrine auto injector) have been prescribed shall always be in the care of a staff member or independent contractor who meets the requirements and is appropriately trained to administer medications.
Evidence:
1. Staff #1, owner, confirmed that there are no staff members employed at the center that are trained in administering emergency medications.
2. Child #1, Child #2, and Child #3 have emergency medications on site at the center and in care during the time of the inspection however no individuals trained to administer their medication.

Plan of Correction: The center responded with the following: The owner will have all staff MAT certified to ensure that medications that are required for children are administered appropriately. Staff obtained information from licensing worker regarding classes offered locally and will sign up.
