Comments:
A complaint inspection was initiated on 5/31/2023 and concluded on 7/13/2023. The inspector reviewed compliance in the areas of administration, staffing and supervision. A total of one child record and six staff records were reviewed. Interviews were conducted with staff and witnesses.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-140-A
Complaint related: Yes
Description: Based on record review the center failed to ensure that each child shall have a physical examination by or under the direction of a physician before the child?s attendance or within 30 days after the first day of attendance.
Evidence:
Child #1 enrolled on 8/2022 but did not have a physical examination on file.

Plan of Correction: Center will not allow anyone to be enrolled until all required information is received by the center.

Standard #: 8VAC20-780-340-A
Complaint related: Yes
Description: Based on interviews the center failed to ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.
During interviews on 5/31/2023 it was determined that Child #1 (three years old) was put in a highchair by staff #7. Staff #7 and #6 stated that child #2 was placed in a highchair for more than 15 minutes, but less than 30 minutes during nap time.
This has been happening daily since the beginning of May, 2023.

Plan of Correction: The center will not allow any children over toddler age in highchairs unless it is meal times.

Description: Based on interviews, the center failed to ensure that when time out is used as a discipline technique it shall be used sparingly and shall not exceed one minute for each year of the child?s age.
Evidence:
Staff #9 stated that child #1 was placed in time out by staff #7 on many occasions. These time outs would last 5-10 minutes each time. Child #1 is three years old and would be limited to three minutes for time out.

Plan of Correction: All staff will be reminded that time out is limited to one minute per age of child. Staff will be recommended to use redirection as a first option.

Standard #: 8VAC20-780-410-2
Complaint related: Yes
Description: Based on interviews and photographs the center failed to ensure that the following actions or threats thereof are forbidden: Enclosure in a small, confined space or any space that the child cannot freely exit himself.
Evidence:
1. Staff # 10 ,9 ,7, 6, stated that child #1 (three years old) has been placed in a highchair for approximately 30 minutes while in the classroom, especially during nap time. Staff #7 and #6 stated that child #1 was placed in the highchair because the child would wake up all the other children in the classroom.
2. Staff # 6, 7, stated that child #1 has been placed in a highchair periodically throughout the day while in the ?big room?. When the child would try to go on the stage, touch a broom or hit other children, the child would be placed in the highchair. Staff # 6 & 7 stated that Child #1 would be in the highchair 15-30 minutes, most days.
3. Staff #7 stated that child #1 was placed in the highchair because the child was allergic to corn. When the center served corn staff #7 would place child #1 in the highchair so the child would not encounter the corn. There was no documentation in the record of child #1 indicating that the child had food allergies.

Plan of Correction: The center will not allow any children older than toddler age in highchairs unless it is mealtimes. The director will ensure that staff are made aware that documentation of allergies must be in the child?s file with documentation from the doctor.
