8VAC20-780 Staffing and Supervision.

Comments:
An announced monitoring inspection was conducted on 07/20/2023 from 2:00 p.m. to 3:30 p.m. in response to a self-reported incident received on 06/28/2023. The inspector reviewed compliance in the areas staffing and supervision. The investigation was conducted in conjunction with local child proactive services.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-400-B
Description: Based on interviews, the center failed to ensure that behavioral guidance is constructive in nature, age and stage appropriate and intended to redirect children to appropriate behavior.
Evidence:
1. In an interview on 07/20/2023, Staff #4 stated that on 06/27/2023, Child #1?s parent reported seeing marks on Child #1?s feet when removing their shoes after leaving the center on 06/26/2023. Staff #4 reported that Child #1?s feet looked bad on 06/27/2023. Staff #4 stated that the shoes Child #1 wore on 06/26/2023 were not meant to be tied, so tying them would have caused marks on Child #1?s feet.
2. In an interview on 07/20/2023, Staff #2 stated that Staff #1 was frustrated and told Child #1 two-three times to put on their shoes. Staff #1 tied Child #1?s shoes too tight leaving marks on Child #1?s ankles. Staff #2 stated that Staff #1 said ?we wear shoes in this classroom? and that Staff #1 tied Child #1 shoes on tight because Child #1 kept taking off their shoes.
3. In an interview on 07/20/2023, Staff #3 stated that they saw Staff #1 tie Child #1?s shoes on 06/26/2023, leaving marks on Child #1?s feet. Staff #3 stated that Child #1 did not take the shoes off for the rest of the day. Staff #3 stated that Staff #1 tied the shoes on Child #1 because they kept taking their shoes off and Staff #1 wanted all children to wear shoes in the classroom.
4. Photographs (CDC_1108702(06-26-2023)P1 and CDC_1108702(06-26-2023)P2) taken by the parent of Child #1 on 06/26/2023, provided to the department by the center, showed red marks on both of Child #1?s feet.
