Comments:
A complaint was received by the Fairfax Licensing office on 8/11/2023, regarding behavior guidance and supervision. On 8/21/2023, an investigation was initiated, in the afternoon between 12:30 pm and 3:55 pm. Staff were interviewed and documents were reviewed. The investigation was completed on 8/24/2023. It was determined that the preponderance of evidence supported the allegation, and the complaint is deemed valid. Description: Based on observation and interview, for each group of children, the center failed to maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.

Evidence:
1. On Monday, August 21, 2023, the arrivals and departures of each child in care were not documented on the attendance sheet for the toddler classroom at the time of the inspection.

2. The daily attendance record maintained at the center consists of a check mark, which indicates when the child arrives but not when the child departs from the center.

3. Staff #1 confirmed that they only document arrivals.

Plan of Correction: Take children's attendance as soon as they come in and sign out children as they leave.

Description: Based on observation and interviews, areas and equipment of the center, inside and outside, were not maintained in a clean, safe and operable condition.

Evidence: The ground covering underneath the resilient surfacing was exposed and lifted, causing a tripping hazard on the playground.

Plan of Correction: Nailed the resilient surfacing an covered it with mulch.

Description: Based on observation and interview, the center failed to ensure the maximum group size limitations were followed when children were in care.

Evidence:
1. On Monday, August 21, 2023, at approximately 12:41 pm, a total of 21 children (17 months to three years of age) were being supervised by 4 staff members in the Toddler classroom during nap time.

2. Several teachers stated that the toddler's classroom had 25 students and 5 teachers on Monday, August 21, 2023, before half-day dismissal at 12:30 pm.

3. The toddler?s classroom has 25 children (17 months to three years of age) documented on the August 2023 attendance sheet.

4. The maximum group size for children 16 to 24 months of age is 15 children.

Description: Based on interviews, the center failed to ensure that when time out is used as a behavior guidance technique that it is used sparingly and shall not exceed one minute for each year of the child's age.

Evidence:
1. Staff #1 reported that on June 13, 2023, they took recess away from Child #26 (4-years-old) for 10 minutes.

2. Staff #1 confirmed that Child #26 was given 10 minutes of time out (thinking time) from playing on the playground as a form of behavior guidance due to the child's behavior.

3. Child #26 is four years old, and time out should have been limited to four minutes.

Plan of Correction: Child #26 have 4 min of thinking time.
