Comments:
An unannounced monitoring inspection was conducted on August 15, 2023 from approximately 12:35 pm to 1:30 pm in response to a self-report that the Office of Child Care Health and Safety received on August 11, 2023 regarding behavioral guidance and forbidden action. The center director was available throughout the inspection to answer any questions.

Three staff were interviewed during the onsite inspection and an additional staff was interviewed by telephone on August 15, 2023. One staff record was reviewed. Information gathered during the inspection determined non-compliance with applicable standards or laws and violations were documented on the violation notice issued to the program.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to me within 5 business days from today.

Please specify how the deficient practice will be or has been corrected. Just writing the word corrected is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Violations:
Standard #: 8VAC20-780-40-E
Description: Based on interviews with four staff and documentation review, the licensee failed to ensure operational responsibilities that the center?s activities and services are maintained in compliance with the standards and the center?s own policies and procedures required by the standards.

Evidence:
1. On 08/11/2023, Staff #2 self-reported an incident that occurred on 08/10/2023 where Staff #1 admitted to forcing Child #1(age 3) to rest in the bathroom during the designated rest period.
2. During an interview with Staff #4, it was stated, that Staff #1 admitted during a meeting with Staff #2 and Staff #4 on 8/11/2023 that she forced Child #1 to rest in the bathroom on 8/10/2023 because Child #1 was not listening.
3. During an interview with Staff #3, it was stated, that Staff #1 told her on 08/11/2023 that she forced Child #1 to rest on his cot in the bathroom on 08/10/2023 and stated, it was dark in there.
4. During an interview with Staff #5, it was stated that she was in the classroom with Child #1 on 08/10/2023 from approximately 12:30 pm-1:40 pm and Child #1?s cot had to be moved several times due to Child #1 being hard to put to nap. Staff #5, stated she left the classroom at approximately 1:40 pm when Staff #1 returned to the classroom. Staff #5 stated, she was surprised that Child #1 was asleep when she returned to the classroom and stated, Staff #1 told her, she slid Child #1?s cot into the bathroom.
5. The center?s policy for Child Guidance, Discipline and Classroom Management states, ?The purpose of discipline for young children is to teach coping skills and discourage inappropriate behavior. At The Learning Experience, the staff models positive behavior and uses methods of discipline which encourage self control, self direction, self esteem and cooperation among children displaying a respect for themselves, their environment and others whom they come in contact. Under no circumstances is any kind of abuse, physical punishment, deprivation or ridicule to be used as a form of discipline.?
