8VAC20-790 Subsidy Program Vendor Requirements for Family Day Homes

Comments:
An unannounced Subsidy Health and Safety Inspection (SHSI) was conducted on August 22, 2023, at approximately 10:20am. This is a voluntarily registered home through the Department of Education in which the provider can supervise and watch up to four children at any given time. There were 4 children that were observed in the home and the provider has 3 grandchildren that live in the home that were also present. The Inspectors reviewed 4 children?s records. Children were observed eating snack, nap, and free play. Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the program.The violations were reviewed and discussed at the exit interview with the vendor.

Violations:
Standard #: 8VAC20-790-170-A
Description: Based on observation and interview, it was determined that the vendor did not ensure compliance with the standards, the terms of the vendor agreement, and all relevant federal, state, or local laws and regulations.
Evidence:
Per the Child Care Subsidy Program Vendor Notification dated July 26, 2023, there were several requirements for the vendor to complete by August 16, 2023:
1. The notification required that the vendor shall send the letter to families regarding the notification. As of the inspection date of August 23, 2023, the letters were not sent to the families.
2. The notification required that the vendor shall post a copy of the parent notification in a prominent place at her home. Upon arrival of the inspectors, the vendor notification letter was not posted.
3. The notification required that the vendor shall produce a valid certificate of completion of the Virginia Annual Health and Safety Update Training for Child Care Staff-2023 (3-hour course). On the day of the inspection the vendor confirmed that she did not complete the course.

Standard #: 8VAC20-790-190-A
Description: Based on record review and interview, the vendor did not ensure that they maintain and keep at the family day home, written or electronic information for each enrolled child, which shall be made available to the department?s representative upon request.
Evidence:
1. Child #1 did not have a written or electronic record and was present at the daycare during the time of the inspection.
2. Regarding Child #1?s record, the provider stated, ?He is just a drop in today and not here regularly.? Vendor confirmed Child #1 did not have a record and only had the mother?s telephone number in her cell phone.

Standard #: 8VAC20-790-260-A
Description: Based on observation and interview, it was determined that the vendor did not ensure that areas and equipment of the family day home shall be maintained in a safe and operable condition.
Evidence:
1. The carpet to the children?s area has a 2-3 foot tear and has threads extended out of the carpet which poses as a tripping hazard.
2. Staff #1 confirmed the tear to the carpet.
